Based on all the information I have collected to date, Charles had only one wife and her full name was Malissa Olivine Huffman Medlock. Here is an affidavit of heirship that is on file in the county clerk's office in Llano Co., TX. Based on this, I don't believe the estate of Charles MEDLOCK or his wife was ever probated at the time or near the time of their deaths. Medlock who deposes and says that he was acquainted with Charles Medlock and wife, M. O. Medlock in their lifetimes; they were husband and wife, and father and mother respectively of this affiant; that said Charles Medlock and M.O. Medlock were married on or about 27 Sep 1859 and that issue of said marriage, seven (7) children and no others were born to them as follows: 1. Jackson Medlock, a son, who died at age about 3 weeks. 2. Jerry Medlock, a son, who died about age 3 days. 3. Charley, a son, who died at age of 11 years. 4. Annie Medlock, a daughter, who married and became wife of J.L. Bruce. 5. Harriet Medlock, a daughter, who married and became wife of W. A. Smith 6. W.W. Medlock, a son who is now 66 years of age. 7. Lizzie Medlock, a daughter, who was married to and became wife of W. R. Campbell 8. R. J. Medlock (this affiant) a son and who is now 58 years of age... Affiant says Charles Medlock, now deceased died intestate on or about 22nd day of Oct 1911 and that M.O. Medlock is now deceased and she died intestate on or about 22 Nov 1911. No administration was ever taken out on the estate either the said Charles Medlock or M.O. Medlock and that there was and is no necessity for any administration on their said estates, that neither the said Charles or M.O. Medlock or their estate owe any debts at that time nor is the estate of them or either of them owing any indebtedness. Sworn and subscribed by R. J. Medlock on this 21 day of Dec 1935. Susan, here are some references to the MEDLOCK surveys in Llano Co., TX. There is some information in these typed documents that does not match the actual original papers on file in the General Land Office in Austin. I will send you that information in another message. The patent letter for the Charles MEDLOCK survey can be found in Deed Book Vol. 53 of Llano Co., TX on page 392: 160 acres of land to Charles Medlock his heirs or assigns...In Llano Co. on Post Oak Branch of the waters of Sandy Creek about 15 and 3/4 miles South and 14 degrees W from Llano town, by virtue of his affidavit before the Clerk of the County Court for Llano County 2 Aug 1879, beginning 860 varas S of the N.E. corner of the Erncarnacion Garzia's survey...Done in the City of Austin Texas 8 Apr 1880 W.C. Walsh Commisioner of the General Land Office and O.M. Roberts, Governor. Filed for record 30 Jun 1920 The early 1880's were hard times for the Charles MEDLOCK family (and before this if you will read the 1870 census closely) and his relations. On 21 Oct 1881 Thomas R. MEDLOCK made application for Letters of Guardianship in regards to the estate of Charles MEDLOCK, a lunatic, in the Probate Court of Llano Co., TX. Note that T.R. Medlock now a resident of Llano County Texas would represent to your Honor that his half brother Charles Medlock also of Llano County is now of unsound mind had has been so adjudged by a competent tribunal of Llano Co. Applicant represents that Charles Medlock is possessed of estate of land and personal property amounting to about $2000.00 mostly situated in Llano County and the said Medlock is unable by reason of unsound mind to manage his estate. It is necessary that his estate be cared for for the benefit of his minor children five in number. The wife of said Charles Medlock is unable by reason of want of education and general business knowledge and information to take care of said estate. Wherefore applicant asks that he or some other suitable person be appointed guardian of the estate of Charles Medlock. Knight Stith, atty for applicant Filed 21 Oct 1881 In a counter plea in Llano Co., TX, Malissa O. MEDLOCK prays the court to appoint her as guardian of her husband's estate. There must not have been many lawyers in Llano Co., TX then; note Malissa used the same lawyer as T. R. did: 1881 - Application of Mrs. Malissa O. R. Medlock as Guardian of said estate of Charles Medlock and prays that she be appointed guardian of the estate and for causes says that she is the wife of the said CharlesMedlock - is the mother of his said five children and has a community interest in his estate and is able to give bond in the said Matter - and alleges that she has general business qualification under the direction and control of the Probate Court to manage said estate, premises considered applicant prays that the application of the said Thomas Medlock for Letters of Guardinship be refused that applicant herein be appointed guardian of said estate and for all other and necessary orders in said matter. Knight Stith, atty for Mrs. Medlock Filed 21 Nov 1881 In another entry in the Probate Court, Malissa prevails: 1881 - 21 Nov 1881 - Estate of Charles Medlock a person of unsound mind - Llano Co., TX Probate Book A, pps 47-48: No. 71 - Estate of Charles Medlock a person of unsound mind) And now on this 21st day of Nov AD 1881 came on to be heard the application of T. R. Medlock for Letters of Guardianship of the estate of Charles Medlock a person of unsound mind and the fact appears to the Court that due and legal notice of said application has been given and also came on for hearing the Protest of Mrs. Malissa O Medlock, wife of the said Charles Medlock, against the appointment of the said T. R. Medlock and makes her application for Letters of Guardianship of the said estate and the said Protest and application of the respective named applicants being heard by the Court it is considered by the the said protest is sustained by the Statements therein contained, and no opposition being made to the appointment of the said Malissa O Medlock as Guardian of said estate: It is ordered by the Court that the Mrs. Malissa O Medlock be and is appointed Guardian of the Estate of the said Charles Medlock and that she enter into bond in the sum of $4,000 and that the Clerk of this Court issue Letters of Guardianship of said estate to the said Mrs. Melissa O Medlock upon her giving bond and qualifying as herein required. and it is furthered ordered that James R. Moss, Isaac Montgomery and Benjamin Ellis be and are appointed appraisers of said Estate and that said Guardian return to this Court a full and complete inventory and appraisment of the property belong to saide estate as required by law. It should be noted by researchers of Charles MEDLOCK, that the land in Llano Co., Tx was in his name, according to the tax rolls, until 1882, then the tax rolls list the land in the name of Mrs. M.O. MEDLOCK (Malissa Olivine HUFFMAN MEDLOCK). 1882 - p. 23: 29 MEDLOCK, Mrs. M.O. - 1031 C Medlock 160 250 It is the case that Charles MEDLOCK, aged 26 in the 1860 census, was listed as a stock raiser with $200 personal property. He was living in the household of John H. HUFFMAN, his brother-in-law in Lampassas Co., TX. According to the census it was John H. HUFFMAN who owned the land in Lampasas Co., TX. A review of the land deeds and a very good search of the Lampasas Co., TX tax rolls for the period indicates that Charles MEDLOCK did not own land in the county as stated in the sketch. Here is my abstract of the tax rolls of Lampasas Co., TX for the tax year 1860: Legend: H - horses, C - cattle Tax Year 1860 No Bilberry p.3: Huffman, J Hughes, J 160 acres $200, 2 town lots in Lampasas $150; 2H $200; 21C $136; $26 misc; $926 total; 1 poll p.4: Medlock, C - no land; 1H $75; 32C $208; $422 misc; $705 total; 1 poll Based on the census and the tax rolls, Charles MEDLOCK was in Lampasas Co., TX in the years 1860 - 1862. He is not listed in the tax rolls of Lampasas Co., TX thereafter through 1910.
