An Act to incorporate the Waco City Cemetery Association. SECTION 1. Be it enacted by the Legislature of the State of Texas, That D. T. Chamberlain, Geo. A. O'Brien, J. E. Sears, J. W. Baar, J. D. Wallace, O. H. Leland, of the county of McLennan, and State of Texas, be and are hereby created a body politic and corporate, with succession under the corporate name and style of the 'Waco City Cemetery Association,' .... SEC. 2. Said association may acquire by gift, device or purchase, the title to any quantity of land, not to exceed one hundred acres, within two miles of the city of Waco, for cemetery purposes .... SEC. 3. Said association shall have as much of said land as they may deem necessary, laid off in suitable lots, with the necessary streets, lanes and alleys, and cause a complete map thereof to be made with the proper number plainly put on each lot, one copy of which shall be deposited in the district clerk's office of McLennan county, and the said association may sell such lots at public or private sale.... SEC. 4. At least one-half of the money arising from the sale of such lots ahll be used in enclosing, protecting, beautifying, adorning and improving said grounds ... that five lots out of every hundred shall be set apart for the burial of the poor ... upon the certificate of one of the justices of the peace ... that ... the deceased did not leave a sufficient estate to defray his or her burial expenses.... SEC. 7. The purchasers of lots from said association shall only have the right to use and appropriate the same for burial or monumental purposes, with the right to beautify and adorn the same....
