August 3, 1919 State of Texas - County of Navarro Know All Men by these present, That we, Mrs. F.M. Grimes, Sr. of Navarro Count7y, Texas, herein after known as the party of the first part, and W.C. Mimms of Navarro County, Texas, hereinafter known as the paerty of the second part, hereby enter into the following contract of sale: Party of the first part hereby sells to party of the second part her tract or parcel of land off of the J.L. French Survey in Navarro county, Texas, known as the "old Kay" place, containing four acres of land, more or less, for a consideration of $1100 to be paid by party of second part to party of the first part as follows: $500 cash to be paid by said W.C. Mimms to said Mrs. F.M. Grimes on September 1, 1919; and the execution by said Mimms of two vender's lien notes in the sum of $275.00 each due respectively December 31, 19120 and 1921 in favor of Mrs. F.M. Grimes Sr. with interest at the rate of 8% per annum, interest payable annually as it accrues. Party of the first part hereby agrees to furnish a good merchanble title to above mentioned land by September 1, 1919. Party of the first part hereby agrees to give possession of the above premises by September 1, 1919. Party of the first part hereby agrees to pay all taxes for the year 1919. Each party to this contract hereby places his and her certified check for $200 to this contract as a guarantee or forfeit that they will carry out his or her portion of the above contract. This contract is to be left in the trust with the Citizens State Bank of Frost, Texas, and in the event that either party to this contract fails or refuses to carry out his or her part of the contact, then the Cashier of said bank is hereby instructed to deliver to the party carrying out his or her part of the contract, both of the checks attached to this contract as liquidated damages for failure to carry out this contract.
