Frazell, L McCord, A.M. Crossland, Soloman Gree & N.F. Jones citizens of Navarro Co. -- Greeting: Whereas at the March Term A.D. 1870 of the county court of Austin County. Pertaining to the Estate of deceased persons, you were by an order of said court, appointed Commissioners to make partition and distribution of a certain tract of land belonging to said Estate mentione in the hereto attache decree, between the estate of W.E. Howth and W.H. Neblett. The Estate of William E. Howth, dec'd. This day came on to be heard the petition of W.H. Neblett praying a division & partition of the hereinafter described tract of land between said Neblett and said Estate and happening to the court that the Administration of said estate has been duly notified of the filing of said petition, and being represented in court, and making no objection to said petition and the court having duly examined and considered the same and said W.H. Neblett, appearing by the contract shown to the court, bearing date October 19th, 1857, to be entitled to one equal half of the land mentioned in said petition for his sevices and expenses incurred in having said land located and patented, and that said estate is entitled to the other half of said land and it appearing to the satisfaction of the court that said Neblett has in all things complied with his part of said contract and has in pursuance thereof, located and obtained a patent bearing date Nov 26th 1861, being patent No 134 Vol 11 for 1280 acres of land lying, being and situated in Navarro county in the State of Texas about 18 miles S 75 W of Corsicanna on the waters of Richland Creek, by virtue of Bounty Warrant No 2892 issued by Barnard E. Bee, Secretary of War of the late Republic of Texas to W.E. Howth as assignee of Edwardo Ramirez on the 14th of April 1836. Beginning on the SW corner of a 160 acres survey made for E.K. Moreell and N.E of G.W. Downing's survey, a stake from which a Mesquite 6 ins in dia bears N60 E 170 varas; Thence N60 E 800 varas, the S.E. Corner of said 160 acre survey a stake from which a Mesquite 12 ins in dai brs S25 W 118 varas; Thence North 30 W 1125 varas to NE corner of said survey a stake from which a mesquite 8 in in da brs S17 W 53 1/2 vrs; Thence north 60 E 1100 varas a stake in the West line of F. Grimes survey; Thence S30 E 4277 vrs to a stake in said line from which an elm 5 ins in dia brs S60 W 220 varas; Thence S 60 W 1900 vars to a stake from which an Elm 6 ins in dai brs N60 E 125 vrs; Thence N30 W at 2383 wrs pass the SE corner of G.W. Downings survey at 3152 vrs to the place of beginning. It is therefore considered by the court, ordered, adjudged and decreed that the prayer of said petition be and the same is hereby granted and a division and partition of said 1280 acres of land between said Neblett and the Administrator of said estate , is hereby ordered and the commissioners herein after named are hereby ordered and directed to divide the aforesaid tract of land in two equal parts or moieties, having due regard to quantity, quality and value and after they shall have so divided said tract, they will allot and set apart one moiety of said land to Mary A. Howth administratrix (with the will annexed) of the Estate of W.E. Howth , deceased for the use and benefit of said Estate, and the other part or moiety they will allot and set apart to the said W.H. Neblett and N.B. Frazell, L. McCord, A.M. Crossland, Solomon Green and N.F. Jones citizens of Navarro County (any three of whom may act are hereby appointed commissioners to make partition as above set forth of said tact of land, and due report make of this proceedings, hereunder at the next or some subsequent time of this court. This further ordered that 1/2 the cost of this partition be paid by W.H. Neblett and the other 1/2 thereof paid by said Administratrix.
