He was the son of James H. Ballard and his wife Nancy A. Farmer. They were both from GA and had married on 24 Feb 1815 in Taliaferro County GA. Elijah was visiting relatives in GA when he claimed residence in Pike County GA and enlisted by Captain Redding for three years or war on 28 June 1862 as a Private in Company H, 44th Georgia Inf. The 44th GA Inf. was part of Gen Lee's Army of Northern Virginia. Elijah participted in every battle from Malvern Hill on 1 Jul 1862 (including Gettysburg on 1-3 July 1863) until Lee surrendered him at Appomattox Court House on 9 April 1865; he was wounded five times. The 44th was organized in March 1862 and numbered 1115 men. When it was surrendered only 62 men remained. Elijah and his boyhood "side-kick" C. Y. Allen were two of these men. Elijah was released from service on 9 April 1865. He and C. Y. returned to AL and then came to Panola County TX. As Captain John Harris CSA remembered years later "The impartial historian, when he collects up the facts and figures, will show that the 44th GA Reg. suffered a greater casualty in killed and wounded, in proportion to the number carried into action, than any other regiment on the Southern side." Elijah became a farmer and married in Panola County TX on 21 May 1869 Eliza Jane Longacre, she the daughter of Uriah J. Longacre, Jr and Harriett E. Hooper. Elijah and Eliza had two children, a son and a daughter. Elijah died on 31 Dec 1919 and Eliza died on 26 Apr 1934. They are both buried in the Waldrop Cemetery Panola County TX. Of interest: Elijah and C. Y. Allen were boyhood friends, joined the Army together, "looked out for each other", came to Texas together and they and their families are buried in the same Cemetery. The State of Texas ) ss County of Panola ) Before me the undersigned authority on this day personally appeared C. Y. Allen who being duly sworn by me deposes and says. I knew E. Ballard when we were boys together and served with him in the same Company and regiment during the Civil War. He was a member of Company H, 44th GA Reg. He enlisted in June 1862 and served until the close of the war. I enlisted in April 1862. He surrendered April 9th 1865 with Lee at Appamdex (sic) Court House. I was with him and surrendered at the same time. /s/ C. Y. Allen Sworn to and subscribed before me this the 7th day of April A. D. 1907. /s/ B. M. Baker Notary Public Panola County Texas
