Wright, Clerk of the County Court and Ex officio clerk of the Board of Land Comr do hereby certify that the following assigned cert, No 446 dated 2nd day of March AD 1838 - that the same had passed the traveling board apt by [congress] to investigate the records of the different land boards east of the Brazos River as a genuine and legal claim against the Govt: {seal} In testimony whereof I have hereunto set my hand and affixed the seal of office this 7th day of September 1841 J. G Wright, Clerk No 446 This is to certify that John McKerly he came to the county and appearing before the Board of Commissioners for the County of Red River and proved according to Law that he arrived in the county on the 28th day of September 1835 a married man as entitled to one league and labor of land upon conditions of paying for survey labor of irrigable land $5.00 for every labor of arable land $2.50 for every labor of pasture land containing in the survey secured to him by the certificate - Given under my hand this 2nd March 1838 M W Matthews, Prest B. McCarley assignment of certificate Republic of Texas } County of Red River } For and in consideration of the sum of Twelve hundred and fifty dollars to me in hand paid the receipt whereof is hereby acknowledged do by these presents assign transfer and set over all my rights title claim and interest that I have in and to the [atm] certificate from me my heirs & c to George W. McKerly his heirs administrators or assigns from and I do hereby assign the said G. W. and empower him to locate and have all the papers field notes and patents made out in his own proper name or assigns administrors & I am [ __] my whereof I have hereunto set my hand and seal this 14th April 1838. Republic of Texas } County of Red River }' This day personally appeared the said John McCarley and acknowledged the execution of the within transfer and assignment for the purposes therein contained - Given under my hand and [ ? ] seal there being no seal of office SD Office in Clarksville this the 13th April 1835[sic] E. McKerly of the Republic and County aforesaid have this day revoked and rescinded the contract between myself and John McKerley relating to the within certificate and I do hereby retransfer all my rights my title to said John McKerly to the within certificate the said John McKerly transferred to me and the power of attorney given to me by the within contract is also rerolled. Lawton Clerk of the County Court & ex officio Recorder in and for the County aforesaid appeared George W. McCarley with whom I am personally acquainted and whose name appears to the annexed and foregoing revocation and rescinding of the contract thereto annexed between himself and John McCarley bearing date the 23 day of November AD 1838 and before me and in my presence acknowledged the same to be his signature and his free voluntary act and deed for the consideration uses and purposes therein containing and expressed and that he signed the same on the day and date there specified - This is fourteenth day of December AD 1846 at Eleven O'clock AM In testimony whereof I have _ set my hand as Clerk and affixed thereto the imprint of my private seal (issuing) as ………………….. State of Texas } County of Red River} Know all men that I John McCarley of said County for and in consideration of the sum of three hundred and twenty five dollars and eighteen and a half cents to me paid by Samuel M. Fulton do hereby sell assign transfer and convey all the rights title and interest which I have in and to two thousand six hundred and five acres (2605) of the annexed certificate No. 446 granted to me by the Board of Land Commissioners for Red River County dated 21 Mar 1838 for one league and labor unto the said Fulton to have and to hold the said two thousand six hundred and five acres to him his heirs and legal representatives forever and do hereby warrant the title to the said against the claims of all persons Witness my hand and seal the 14th day of December AD 1846 Test: Geo W. Lawton Clerk of the county Court and Ex Officio Record in and for the County aforesaid appeared George W. McCarley with whom I am personally acquainted and whose name appears to the foregoing and annexed assignment and transfer of certificate number 446 Issued by the Board of Land commissioners of Red River County to John McCarley and dated the 21 day of March 1838 as one of the subscribing witness an after being duly sworn as the San Directo debt depose and say that he subscribed his name thereto as a witness at the request of the parties that he saw John McCarley sign seal and acknowledge the same as his free voluntary act and deed for the consideration and use and purposes therein contained and expressed on the day and date therein specified on the fourteen day of December AD 1846 at Eleven o'clock AM …………… Note: George W.
