All rights reserved. http://www.usgwarchives.net/copyright.htm **************************************************************** Know all men by these present that Jonathan Montgomery of Red River county, and state of Texas, being of sound mind and disposing? memory and wishing to make a proper distribution of my property do make and ordain this my last will and testament viz. first I will that my executor hereafter named shall proceed as early as practical to pay all my just debts and to enable him to do so, he may sell or dispose of any personal property that may belong to my estate. Secondly, whereas I have heretofore given to my following named children (viz.) George W., Elizabeth Rebecca, Mary Aouline, and J. Britain Montgomery each property estimated by me to be worth one hundred dollars - My will is that each remaining children recieve out of my estate one hundred dollars and whatever property or effects (if any) that may remain to my estate I want to be equally divided among my entire children or their bodily heirs in equal portions and having entire confidences in my son William R. Montgomery I hereby appoint him my executor and release him from giving Bono as said executor and I wish the Probate Court to take no further action with my estate than the recording this my will with an inventory of my property and I hereby revoke and make null and void all instruments heretofore executed by me preporting to be a will and should if be necessary for my negroes to be sold I hereby require the entire family sold in a lot together. Carr THE STATE OF TEXAS RED RIVER COUNTY I James Gilliam one of the subscribing witnesses to the foregoing will and testatment of Jonathan Montgomery deceased do hereby certifiy that I was present at the time of the signing of said will by the testator and saw him sign said instrument as his last will and testament in my presence and in the presence of the other said subscribing witness James B. Carr and at the request of said testator we signed the same in the presence of each other and the said Montgomery deceased the same to be his last will James Gilliam Sworn to and signed before me this 23rd day of October 1871.
