San Rogers, Judge of said Court: Now comes R. R. Holdert, administrator de bonus non, with will annexed, of the estate of Julia Bates, deceased, and represents to the court, that all the debts of every kind, known to your administrator, against said estate, have been paid, except the following two claims; (a) Claim of Federal Land Bank of Houston, Texas, in the sum of $978.53, as of July 24th, 1937, said claim being secured by a lein on the real estate described in a deed of trust to M. H. Gossett, Trustee for said bank, and also described in said claim; that same is not a claim against the estate of the said Julia Bates, generally, but same has been allowed and approved as a claim against the specific property described in said claim, and secured only by a lien on said real estate, and payable only from the proceeds of the sale of said property. (b) Claim of Federal Farm Mortgage Corporation of Houston, Texas, in the sum of $3144.53, as of July 24th, 1937, secured by a lien on three tracts of land, aggregating 247 acres of land, situated in Robertson County, Texas, described in said claim; that said claim is not a claim against the estate generally of the said Julia Bates, but is payable only out of the proceeds of the sale of said real estate, and is secured only by said real estate. That the above facts fully appear from his final account this day filled herein in this court, and verified by affidavit as required by law. Wherefore your petitioner prays the court that citation issue herein as required by law, and that an order be made and entered by this court discharging your petitioner and his bondsmen from all further liability and trust, as administrator, and as his bondsmen, and that the money in the hands of your petitioner be partitioned and distributed among the rightful owners, but that the real estate be turned over to said owners without any partition thereof; and that said estate be closed. Holbert, administrator de bonus non, with will annexed, of the estate of Julia Bates, deceased, and respectfully herewith presents his final account with said estate, as follows, to-wit: 1. Since he quilified as such administrator the following porperty belonging to said estate has come into his hand, to-wit: (a) Real Estate: An undivided one-half interest in and to a tract of 76.2 acres of land, a part of the T. J. Chambers League; an undivided one-half interest in and to a tract of 182 acres of land, a part of J. Matthews Survey, Abstract No. 261; an undivided one-half interest in and to a tract of 12.6 acres of land, a part of the T. N. Mudd Survey, Abstract No. 229, all in Robertson County, Texas, and fully described and valued in original inventory filed herein. (b) Personal Property: Cash in the First State Bank of Bremond, Texas, the sum of $254.86 (c) Claims due the estate none (d) Money collected as rents and from Government program (one-half of $414.02) $207.01 2. He has not disposed of any of the said real estate. 3. All debts and expenses of said estate have been paid, so far as known to your administrator, except the claims due the Federal Land Bank of Houston, Texas, in the sum of $978.35, and the debt due the Federal Farm Mortgage Corporation of Houston, Texas, in the sum of $3,144.53, as shown in paragraphs (a) and (b) of your administrators's application for discharge. Said two claims are not claims against the general assets of said estate, but each is secured only gy the real estate described in said claims, and were fixed and established as provided by law. 6. The following property belonging to said estate still remains on hand, to-wit: (a) The real estate hereinabove mentioned and described (b) Cash, in the First State Bank, of Bremond, Texas, in the sum of $100.33 7. The persons entitled to receive said estate, all being adults, and the quantity and amounts to which each is entitled, are as follows: (a) Mrs. John H. Lomax, under the will of Mrs. Cora L. Sandel, deceased, of Franklin, Texas, the sum of $25.08 (b) Mrs. Padie Taylor, of Los Angeles, California, under the will of Mrs. Julia Bates, dcd., the sum of $25.08 (c) Mrs. George V. White, surviving wife of George V. White, dcd., 1/3 of $50.17, being the sum of $16.72 (d) Bates White, son of Geo. V. White, the sum of $11.15 (e) George White, son of Geo. V. White, the sum of $11.15 (f) Mrs. Rose White Luther, daughter of Geo. V. White, dcd., the sum of $11.15 All of the Whites are adults, and reside at Houston, Texas. 8. No advancements have been made by me to any of the persons entitled to receive said estate. 9. I herewith present proper vouchers in support of each item of this account, and ask that the account and vouchers be filed with the clerk of this court. R. R. Halbert, Administrator In Re: Estate of Julia Bates, deceased In County Court of Robertson County, Texas, April Term, 1938 On this the 25th day of April, A.D. 1938, at a regular term of this court, came on to be considered in the administration, with will annexed, of the estate of Mrs. Julia Bates, deceased, the final account of R. R. Holbert, administrator of said estate; and it appearing to the court that due notice has been given of the filing thereof, according to law, the court proceeded to examine the said account and the vouchers accompanying the same and to hear all exceptions and objections thereto, and the evidence in support of and against the account, and, having fully considered the same, and finding same true and correct; and the court further finding that it is not necressary to restate said account: It is therefore ordered, adjudged and decreed by the court that the said account be and the same is hereby in all respects approved and ordered of record, and that the said R. R. Holbert, administrator with will annexed, as aforesaid, and his bondsmen on his bond be and they are hereby fully discharged from any and all further trust and liability herein, and that they and each be and are hereby fully discharged, and said administration is hereby finally closed.
