BATES, ROBERTSON COUNTY, TEXAS NO. 2333 The State of Texas, County of Robertson In the Estate of E.H. Bates, deceased, In County Court of Robertson County, Texas September Term, A.D. 1933 To the Honorable County Court of Robertson County, Texas: 1st: Now comes your petitioner Julia Bates, and respectfully shows to the court that she resides in Robertson County, State of Texas; that E. H. Bates is dead and that he died on and about the 29th day of June, A.D. 1933, in the county of Robertson, State of Texas; that said deceased at the time of his death was a resident of Robertson County, Texas and that his estate was located and situated in said county and state. 2nd: That at the time of his death the said E. H. Bates was seized and possessed of real and personal property, of the probable value of $5,000.00 and left a written will, duly executed and herewith filed, in which your petitioner was appointed executrix. 3rd: That your petitioner is not disqualified by law from accepting letters testamentary. 4th: That said will appoints and constitutes your petitioner executrix thereof without bond for her legal performance of the same, and further provides that no further action be had or taken by the probate court, other that probating the same, and filing an inventory and appraisement of said estate. Wherefore, your petitioner prays the court that citation be issued to all parties interested in said estate as required by law, that said will be admitted to probate, that letters testamentary be issued to your petitioner, and that such other and further orders be made as to the court may seem proper. Bates of the county of Robertson, State of Texas, being sound in mind and over the age of twenty one years, and knowing the uncertainty of life and the certainty of death and wishing to depose of my possessions and belongings, both in real estate and person property, while in health and strength do make this my will. 1st: After the payment of my just debts I will and bequeath to my beloved wife Julia Bates all of my estate wherever situated or however acquired, whether by _____ or inheritance or otherwise which may consist of lands and improvements, machinery, stock, money, notes and accounts or any and all of everything which I may be possessed of at my death, or may come into my possessionby reason of inheritance or otherwise after my death, for her use, benifit and mantenance during her natural life, to use and operate as her own. 2nd: I direct that my wife Julia Bates take charge of my entire estate as provided above, but at her death I will that George V. White, who is a brother to my wife Julia Bates, shall inherit in fee simple. All that part of said estate that may be legally or equitably vested in me, both of real estate and personial property. 3rd: In the event that my wife Julia Bates should marry again, then I direct that my wife's brother George V. White shall enter and take possession of in his own name and right all my interest effective by law and equity. 4th: I hereby nominate and appoint my wife Julia Bates the executrix under this my will and testament, and that she is to act as said executrix without bond or other security. 5th: I will and direct that the probate court have nothing to do with my estate other than to probate this will and file an inventory and appraisement. Bates, deceased, produced before the undersigned appraisers, on the 5th day of January, A.D. 1934, by Julia Bates, executrix of the estate of the said E. H. Bates, deceased. SEPARATE PROPERTY OF THE SAID E. H. BATES, DECEASED; NONE. COMMUNITY PROPERTY OF THE SAID E. H. BATES, DECEASED: 247 acres of land, a part of the T. J. Chambers Survey, in Robertson County, Texas, valued at $3408.00. Said tract of land encumbered with a debt and lien of $3408.00 83.9 acres of land, more or less, a part of T. J. Chambers Survey, valued at the sum of $839.00 12 & 1/2 acres, more or less, a part of the T. N. Mudd Survey, valued at the sum of $125.00 182 acres, more or less, a part of the Jos. Mathews Survey, valued at the sum of $1820.00 The interest of the said E. H. Bates in the above described lands being an undivided one-half interest. An undivided one-half interest in and to the following personal property: About 114 head of cattle, valued at the sum of $798.00 Nine (9) mules and one (1) horse, valued at $350.00 Farming implements, valued at __?__ We, the undersigned appraisers, solemnly swear that the foregoing is a full and fair appraisement of the estate of the said E.
