Smith, a resident of Rockwall county, files suit against the Western Union Telegraph company for $5,000. The plaintiff alleges a mesage was delivered to the defendant's agent at Cedar Hill apprising him of the death of his brother who lived at that place. The plaintiff further alleges that the message was not received by him until too late to be at his brother's funeral. The delay of the message was due to the negligence of the defendant's agents. The plaintiff claims to have suffered great grief and mental anguish owing to the fact that he was not able to attend his brother's funeral which was cause by the negiligence of the defendant's agents. - November 19, 1890, Dallas Daily Times Herald, p. 2, col. 2.
