Starrs labor, thence N to the NE corner of said 640 acre Survey, thence S West this same variation of James Smith's headright, thence with Said line to the place of beginning of the 640 acre Survey those boundaries to include two hundred acres more or less. Now the conditions of the above obligation is such that if the above named James Smith shall make a good valid title to the aforesaid Franklin Cook So soon as he, the said Smith shall obtain a Patent for his land from the Government, then this obligation to be null and void, otherwise to remain in full force and virtue in law. Roome * * * * * * * The Republic of Texas ) County of Rusk ) For and in consideration of four Hundred dollars to me in hand paid by William B Ochiltree of the county aforesaid, I have this day bargained sold and delivered and do by these presents bargain sell and deliver unto the said Ochiltree, his heirs and assigns forever, all the within described premises and all the rights and immunity therein described as conveyed to me by James Smith.
