Lemons Smith Co., TX, Deed Book 34, pages 360-361 [p. 360] The State of Texas County of Smith Know all men by these presents that we Philip J. Pryor and Thomas G. Hardigree all of the county of Smith in the state of Texas, in consideration of the sum of Three hundred dollars paid and to be paid by William L. Dunn also of said county and State of which amount one hundred dollars is paid in cash and one hundred dollars with interest at 10 per cent per annum from date is to be paid Jan 1, 1887 and one hundred dollars with interest at 10 per cent per annum from Jan 1st 1887 is to be paid Jan 1st 1888 all of said notes payable to Jno B Pryor or bearer, the receipt of which is hereby acknowledged, we do by these presents, grant, bargain, sell, release and convey unto the said William L Dunn the following described land towit: Situated in Smith county in the state of Texas about six miles East from the city of Tyler, and more particularly described as follows: Being an undivided interest of one hundred acres in and to three hundred and fifty-seven and one half acres, being part of the C. C. Alexander, W. W. Sheppard[,] Sherby Gage and M. H. White headright surveys fully described in deed from Daniel Smyre and wife to L. M. Pryor made on the 3rd day of January 1870, which is on record in book "T," on pages 53 and 54 record of deeds of Smith County, the interest herein conveyed being an undivided interest of 14-7/8 acres in said land belonging to Philip J Pryor as one of the heirs of his sister Beulah Pryor, who died October 13th 1885; an undivided interest of 25-3/4 acres belonging to said John B. Pryor as one of the heirs of said Beulah Pryor deceased, and also as one of the heirs of G. W. Pryor who died in November 1881, both of said deceased parties being children of L M and E. C. Pryor deceased; and an undivided interest of 59-3/4 acres belonging to Thos. G. Hardigree as the heir of his only child Bertha R Hardigree, grand child of L. M + E. C. Pryor deceased, said Bertha R having died Oct 2 188_ [1885?], and being the only child and heir of her mother Mary E. Hardigree who died September 5, 1884. To have and to hold said land with all the rights, privileges, appurtenances and improvements to the same belonging or appertaining thereto, unto the said William L. Dunn heirs and assigns [p. 361] forever. And we the said Philip J. Pryor, John B Pryor and Thomas G. Hardigree do hereby bind ourselves, our heirs and legal representatives to warrant and forever defend the title to said premises unto the said William L Dunn his heirs and or assigns against every person whomsoever lawfully claiming or to claim, the same or any part thereof.
