Scott MORTGAGE, Smith County, TX This indenture made the 5th day of November in the year One Thousand Eight Hundred and Seventy-Two between J. D. Scott party of the first part and T. G. Erwin, Adm. of Estate of A. O. Erwin dec'd, party of the second part witnesseth that the said party of the first part in consideration of the sum of Two Hundred and Forty Dollars in U. S. Currency, 10 percent interest to him duly paid before the delivery hereof has bargained and sold and by these presents does grant and convey to the said party of the second part and his heirs, assigns forever all of Block No. 3 containing 35-5/9 acres of land, of the Johnson Wright Headright (sold by order of Court to highest bidder) with the appurtenances and all the estate rights, title and interest of said party of the first part therein. This Grant is intended as a security for the payment of a promissory note for above amount $240.00 which payment if duly made will render this conveyance void, and if defaulted shall be made in the payment of the above amount mentioned then the said party of the second part or his executors, administrators or assigns are hereby authorized to sell the premises above granted or so much thereof as will be necessary to satisfy the account there due with the costs and expenses allowed by law. Denson of said County and State in consideration of the love and affection which I have and bear to my beloved daughter Mary C. Scott, wife of Jno. D. Scott do hereby give, donate, grant, transfer and deliver unto the said Mary C. Scott, her heirs and assigns for her sole separate use and benefit a certain vendor's lien note attached hereto and referred to as a part hereof. Said note dated July 10th, 1879 payable to W. S. Herndon or bearer Dec. 1st, 1879 for the sum of (306.00) three hundred and six dollars with 10% interest thereon amounting now to about $320.00. The said note was a renewal note dated Nov. 5th, 1872 for the purchase money of 35-5/9 acres of land part of the Johnson Wright Headright located about 2 miles West of the Courthouse in Smith County. The said land conveyed to the said Jno. D. and Mary C. Scott by T. G. Erwin, administrator to have and to hold the above described vendor' lien note being the purchase money due on said thirty five & five ninth acres of land unto them the said Mary C. Scott for her sole and separate use, her heirs and assigns forever. Witness my hand this the 2nd day of February A. D. 1881 ------------------------------------------------------------------ The State of Texas County of Smith Know all Men by these presents That I, of the County of Smith State of Texas in consideration of the sum of Four Hundred and seventy five DOLLARS paid and secured to be paid by J. D. Scott of Smith County Texas as follows: One promissory note for four hundred and seventy-five dollars due and payable on the 30th day of May 1889. Have Granted, Sold and Conveyed, and by these presents do Grant Sell and Convey unto the said J. D. Scott of the County of Smith and State of Texas all that certain tract of land known as Block 3 No. 4 as surveyed and platted and being a part of the Johnson Wright Headright of 320 acres located about 2 miles West of Tyler and more fully described in a deed from T. G. Erwin admin of the Estate of A. O. Erwin deceased. (?) J. M. Jessop dated May the 7th, 1873 to which reference is here made and being the same land deeded to me by J. M Jessop, Nov 6th, 1873 in which deeds references is hereby made. Said Block No. 4 containing 35-5/9 acres of land and bounded on the East by Blck no. 3 and the North by Block No. 5 and on the West by Block No. 9. Said tract of 320 acres having been surveyed into 9 Blocks numbered from 159 inclosin(sp) each containing 35-5/9 acres of land. The above tract of land as described, being the source deeded to me by W. S. Herndon on the 19th day of May 1888. TO HAVE AND TO HOLD the above described premises, together with all and singular, the rights and appurtenances thereto in anywise belonging, unto the said J. D. Scott his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof. BUT IT IS EXPRESSLY AGREED AND STIPULATED that the VENDOR'S LIEN is retained against the above described property, premises and improvements, until the above described notes, and all interest thereon are full paid, according to the face and tenor, effect and reading, when this deed shall become absolute.
