D. Spivey and E. F. Spivey of the county of Smith and State of Texas and V. C. Spivey and her husband John Pearce of the county of Kaufman in the State of Texas and G. B. Spivey of the county of Smith and State of Texas, J. M. Spivey, M. H. Pearce and her husband J. H. Pearce of the State of Colorado, and S. A. Holbrook and her husband J. T. Holbrook of the county of Savana in the State of Texas, the said G. W. Spivey, S. A. Holbrook, J. L. Holbrook, M. H. Pearce, J.H. Pearce and G. B. Spivey acting by and through G. W. Spivey their agent and attorney in fact, for and in consideration of the sum of Twelve Hundred Dollars to us in hand paid by A. M. Murphy and W.C. Scott of the county of Smith and State of Texas, the receipt whereof is hereby fully acknowledged, have this day granted, bargained, sold, released, and conveyed, and by these presents do grant, bargain, sell, release and convey unto the said A. M. Murphy and W. C. Scott the following described lot, tract, or parcel of land situated in the City of Tyler in the County of Smith in the State of Texas, and bounded as follows: Commencing at the South most corner of a tract of land sold by William Davenport to W. S. Walker. Thence West to a lot of land sold by William Davenport to john Clay. Thence North to the North east corner of said Clay's lot. Thence East to the North West corner of the Walker lot. Thence South with the West boundary of the said Walker lot to the place of beginning containing Three and Two-tenths acres, which place is commonly known in the City of Tyler as the Spivey Place. To have and to hold the said above described premises together with all and singular, the appurtenances and improvements therein situated, to the said A. M. Murphy and W. C. Scott, their heirs, and assigns forever. And we do hereby bind ourselves, our heirs, executors and administrators to warrant and defend the same to the said A. M. Murphy and W. C. Scott, their heirs and assigns forever against the lawful claim or claims of any person or persons claiming or to claim the said or any part thereof. Johnson, Deputy --------------------------------------------------------------------- TAX SALE DEED The State of Texas County of Smith Know all men by these presents That Whereas certain taxes are due the State of Texas and the county of Smith by G. W. Spivey as assessed against him for the year 1874 upon the following described tract or parcel of land, viz: Three and 1/5 acres Isaac Lollar Headright which taxes amounted to the sum of Eleven Dollars and Twenty-One cents as appears from the tax roll of said County for the year 1874. And Whereas, the time provided by law for the payment of said Taxes having expired, and though demanded of the said G. W. Spivey by proper legal notice, the same remaining unpaid, I J. F. Patterson, Tax Collector of Smith County, in compliance with the law, and by virtue of the tax roll aforesaid, levied upon and seized certain tract of land, as belonging to the said G. W. Spivey and hereafter described, to be sold, to make the said amount of said taxes yet unpaid, together with costs accrued, and have advertised the said lands in the manner and for the time prescribed by law; and whereas, in pursuance with the said advertisement I did offer said lands for sale at Public Auction, at the time, place, and in the manner required by law, when W. C. Scott and A. M. Murphy bid the sum of Eleven Dollars and twenty-one cents for 3-1/5 acres of said land, which sum, being sufficient to make the said amount of said unpaid taxes, together with Four Dollars and Fifty cents costs accrued thereon, and the costs of this deed, which being the highest and best bid offered for the least number of acres of said land, the same was struck off to them, the said Scott and Murphy. Now, Therefore for and in consideration of the sum of Fifteen Dollars and seventy-one cents, to me in hand paid, the receipt of which I hereby acknowledge, I have, by virtue of the power in me vested by law, bargained, sold, transferred, and conveyed, and by these presents do bargain sell, transfer and convey unto them the said Scott and Murphy heirs, assigns, all the right, title, interest and estate, which the said G. W. Spivey had at the time when the assessment before mentioned was made, to the following tract or parcel of land, viz: Three and 1/5 acres of the Isaac Lollar Headright TO HAVE AND TO HOLD, unto them the said Scott and Murphy their heirs and assigns, the above and foregoing tract of land, together with all and singular the rights, privileges, and appurtenances to the same belonging, or in any way appertaining, in fee simple forever; Provided, nevertheless, that the said land herein conveyed may be redeemed by the said G. Scott, died in Smith County, Texas about February 12th, 1895, leaving as her sole heirs, her husband John D. Scott, and the following children towit: Ura Scott, Mrs. Ida Watts, formerly Ida Scott, Mrs. Georgia Davis, formerly Georgia Scott and myself J. Walter Scott, and left to her said heirs a separate estate owned in her own right and also a community estate of herself and husband' and whereas, there has been a settlement as between myself on the one side and the other above named heirs on the other of all matters and things concerning both the separate and community estate of my said mother, by the terms of which settlement the other said heirs have this day conveyed to me, the said J. Walter Scott, a certain lot in the City of Tyler, TX, which said lot I have received and accepted from said other heirs in full and final satisfaction of all interest whatsoever I now or have ever owned in both the separate and community estate of my said mother Mary C. Scott deceased; and in consideration of the conveyance to me by said other heirs of the said lot, which is fully described in a deed this day executed to me by them, I, the said J. Walter Scott, do by these presents, forever release, relinquish all further claim whatsoever to any other or further interest in and to the estate of my said mother, both separate and community, wherever the same may be located; and I do by these presents, forever quit claim unto the said John D. Scott, Ura Scott, Mrs. Ida Watts and Mrs. Georgia Davis all interest whatsoever I have or ever had n and to both the separate and community estate of my said mother, Mary C. Scott, save and except my interest in and to the lot they have this day conveyed to me; and do here and now accept the said lot in final satisfaction of all my interest of all the estate of said Mary C.
