L. SMITH, COLORED, GIVEN TWO YEARS IN THE PENITENTIARY FOR MANSLAUGHTER, AN OLD CASE The jury in the case of the State of Texas vs. Jas. L. Smith, returned a verdict this morning, giving him two yaers in the penitentiary. The case was called to trial Monday in the district court and was given to the jury yesterday afternoon. The crime for which Smith was tried was committed four years ago, the killing taking place at a ball game when the defendant struck the victim from the effect of which he died. Self defense was the plea entered by the defendant's attorneys, who introduced evidence that the man who was killed was coming at defendant with a brick in his hand when defendant struck him with a ball bat. The case of Albert Jones, charged with the killings of Andrew J. Glaze was set for trial today, a special venue of fifty men having been summoned from which to select a jury. The entire morning was consumed in the selection of the jury, the venire of fify men being exhausted. Many of them were not present on account of sickness. Only eleven men were selected. Another special venire was ordered summoned by the judge to be present at the afternoon session, at which time the twelfth man was selected and the case went to trial. The defendant stands charged with murder. He is a brother-in-law to the deceased. The only information the Courier can obtain relative to the affair is that Glaze went to the home of Jones and was killed, a single barrel shot gun being the weapon used. There were two eye witnesses to the shooting, one of them the wife of the defendant, and the other a negro man. The defense is that the killing was accidental.
