Herring, do hereby make application to the Commissioner of Pensions for a pension to be granted me under the Act passed by the Thirty-third Legislature of the State of Texas and approved April 7, 1913, on the following grounds: I enlisted and served in the military service of the Confederate States during the war between the States of the United States, and I did not desert the Confederate service, but during said war I was loyal and true to my duty, and never at any time voluntarily abandoned my post of duty in the said service; or (that I was in the service of the State of Texas during the war to protect said State against the Indians and Mexicans for more than 6 months.) that I was honorably discharged or surrendered -- was discharged at the close of the war in April 1865; that I have been a bona fide citizen of this State since prior to January 1, A. D. 1900, and have been continuously since a citizen of the State of Texas. I do further state that I do not hold any National, State, city or county office which pays me a salary or fees of $300.00 per annum, nor have I an income from any other employment or other source whatever which amounts to $300.00 per annum, nor do I receive from any source whatever money or other means of support amounting in value to the sum of $300.00 per annum, nor do I own in my own right, nor does any one hold in trust for my benefit or use, nor does my own wife own, nor does any one hold in trust for my wife, estate or property, either real, personal or mixed, either in fee or for life, of the assessed value of over one thousand dollars, exclusive of a home of the value of not more than $1000.00; nor do I receive any aid or pension from any other State, or from the United States, or from any other source, and that I am not an inmate of the Confederate Home, and I do further state that the answers given to the following questions are true: 1. What is your age? Seventy Eight (78) 2. Where were you born? Morag County, Alabama 3. How long have you resided in Texas? Since 1872 4. In what county do you reside? Uvalde County, Texas 5. How long have you resided in said county, and what is your postoffice address? Came to Uvalde County about the 15th of July 1919, Post Office Address, Knippa, Texas (R.F.D. No. 1); Came here from Falls County, Texas 6. Have you applied for a pension under the Confederate pension law and been rejected? If rejected, state when and where. No 7. What is your occupation, if able to engage in one? None. What is your physical condition? Poor 8. In what State was the command in which you served organized? Alabama 9. How long did you serve? Give, if possible, the date of enlistment and discharge. Enlisted Aug. 19, 1862. Discharged April 9th, 1865. 10. What was the letter of your company, number of battalion, regiment or battery? Company D, 1st Alabama Cavalry 11. If transferred from one command to another, give time of transfer, name of command and time of service. Was not transferred 12. What branch of the service did you enlist in -- infantry, cavalry, artillery or navy? Cavalry 13. If commissioned direct by the President, what was your rank and line of duty? Was not commissioned 14. If detailed for special service, under the law of conscription, what was the nature of your service and how long did you serve? I volunteered 15. What is the assessed value of your home, if you own a home? Do not own one. My wife, who died August 26th, 1919, owned 110 acres of land, which was her separate property, and which was inherited by her children. I rendered the property for taxes, and possibly it is rendered in my name, but I do not own it. 16. What is the assessed value of your other property? Have none. The land was in Falls County. For about 4 years my wife and I lived around amoung our children and that is from about 1915 to time of her death last Aug. 17. Have you transferred to others any property of any kind for the purpose of becoming a beneficiary under this law? Herring has not been found as of either the 1st or 5th Regiment, Ala. Cav., C.S.A. Records show however that Henry T. Herrin, pvt., Co. K, 62 Ala. Inf. (formerly the 1st Regt. Ala. Junior Reserves), C.S.A., enlisted June 20, 1864, at Selma, Ala, and on roll for June 20 to Aug 31, 1864, was shown absent sick in hospital since Aug 20, 1864, age 16 (last roll on file). Other records show that H. T. Herrin, pvt, Co. K, 1st Regt, Ala Res., C.S.A., was admitted to Ross Hospital, Mobile, Ala, Mar 27, 1865, complaint debilities, and sent to Genl. Hosp., Mar 30, 1865, remarks - Miordian. Union Pris. Of war record shows that he was surrendered May 1865, and paroled at Darnopolis, Ala, June 8, 1865 A. C. Herring, who lives in Uvalde County, Texas. This applicant owns no property in Uvalde County, but you will note from his application that he ownes some interest in some land in Falls County, Texas. You will therefore be authorized to make such investigations as you may see fit, as I am of the opinion that it may be he is not entitled to a pension, but this is a matter that is solely in your hands. You will please have these interrogatories completed and returned to this office to be filed with your application and on receipt of same they will receive prompt attention. Wright, Hartselle, Alabama, RFD #3 to the accompanying interrogatories (2) ____ propounded to them in the above entitled cause taken before (3) Jno. L. Foote, Notary Public in accordance with the accompanying (7) ____. To the first interrogatory the said ___ Witness, answers J. J. Summerford and L. B. Wright, 70 and 75 years, respectively. 2. Yes 3. Since 1861 4. We know that he enlisted in the Service and performed the duties of a soldier 5. C. D, 5th Alabama Cavalry 6. He was a private soldier 7. He was a volunteer in the Confederate Army Cross Interrogation 1 & 3 We state that we know that Henry T. Herring and the man in question is the identical man now making application for pension. The said L. B. Wright having served in the same Company and Regiment. 3 We know of our own personal knowledge the said Henry T. Herring rendered honorable service in his said Company and that he surrendered at Danville, Ala, in 1865. 4 He did not desert but surrendered at Danville, Ala. Foote, Notary Public ************** APPLICATION FOR MORTUARY WARRANT THE STATE OF TEXAS County of Uvalde I, Mollie Hughes, do hereby certify that I am the person to whom is entrusted the paying of the accounts and indebtedness of the late Henry T. Herring, who was a pensioner of the State of Texas, and whose file number is 37007 and whose original county was Uvalde. The said pensioner Henry T. Herring died on the 25th day of January 1924, in the town of Sabinal, Uvalde County of Uvalde, Texas. The pensioner died in the home of Mollie Hughes who was related to the pensioner as daughter. That the warrant, which application is hereby made for, shall be applied to paying all or part of the funeral expenses incurred by the said pensioner Henry T. Herring. I further certify that the warrant for the current quarter has not been cashed by the pensioner, to the best of my knowledge and belief. I am related to the pensioner as daughter, that my postoffice address is Sabinal, Texas. O'Neill, do certify that I am undertaker in the town of Sabinal, County of Uvalde, State of Texas, that I had charge of the body of Henry T. Herring, who died in the town of Sabinal, County of Uvalde, State of Texas on the 25th day of January 1924. That said body was prepared for burial by me on the 25th day of January 1924, and that I am of the opinion that warrant herein applied for should be issued to the said Mollie Hughes, who makes the foregoing application. Herring in his last illness, and am of the opinion that his ailments were fracture of neck, of femur, and senility.
