McBee to Henry Fuller Warranty Deed; State of Texas ] Van Zandt County ] Know All Men by These Presents, that I John G. McBee, of the County and State aforesaid in consideration of the sum of ($206.40) two hundred and six dollars and forty cents to me in hand paid by Henry Fuller of the above named County and State, the receipt whereof is hereby acknowledged to hereby give , grant, bargain, sell and convey unto the said Henry Fuller, his heirs and assigns forever, a certain tract of land described and bounded as follows: Being part of Survey No. 106 in the name of W. H. McBee and being part of the portion which was set apart to Silas P. McBee by the commissioners appointed (by the Probate Court of Van Zandt County in said State of Texas) at the February Term 1854. (the report of said commissioners was approved at the March term of said court) to partition and the Estate of Wm. H. McBee, Deceased, among his heirs and being part of the partition which was set apart to John G. McBee by the commissioners appointed (by the Probate Court of Van Zandt County in the aforesaid State) at the June Term 1857. (The report of said commissioners was approved at the August term AD 1857, of the aforesaid Court) to partition and divide the estate of Silas P. McBee, Deceased, among his heirs at law. Beginning from the N. corner of the portion that was allotted to John G. McBee which is 771 ¾ vs. S. 45 degrees W. a post (which is 771 ¾ vs. S. 45 degrees W. from the N.W. line of Survey No. 106 in the name of Wm. H. McBee) from which a Post Oak brs. S. 46 degrees W. 16 ½ vs, dist; Thence S. 45 degrees E. 342 vs. to rock for corner, from which an Elm brs. N. 10 degrees E. 3. vs. dist: Thence S. 45 degrees W. 1543 ½ vs to stake for corner in prairie; Thence N. 45 degrees W. 342 vs. to stake for corner in prairie; Thence N. 45 degrees E. 1543 ½ vs. to the beginning; with all the privileges thereto belonging to have and to hold the afore granted premises to the said Henry Fuller his heirs and assigns to his and their use and behalf forever. I the said John G. McBee for myself, my heirs, executors and administrators do covenant with the said Henry Fuller his heirs and assigns that I am lawfully seized in fee simple of the afore granted premises that they are free from all encumbrances that I have good right to sell and convey the same to the said Henry Fuller as aforesaid and that I will, my heirs, executors, administrators shall warrant and defend the same to the said Henry Fuller, his heirs and assigns forever, against the lawful claims and demands of all persons whatever.
