Groom & F.M. Hobbs Deed of Trust; The State of Texas ] County of Van Zandt ] Know all Men by These Presents; that I, J.G. McBee of said County of Van Zandt in the State of Texas for and in consideration of the sum of ten dollars to me cash in hand paid by John P. Groom a resident of said County and State have this day granted, bargained and sold said John P. Groom the following: (The within Trust Deed or Deed of Trust is satisfied in full this September 8th 1875. J.P. Groom and F. M. Hobbs ) described tracts of land an undivided one-half interest in a two hundred acre tract of land a part of the Headright of Wm. H. McBee which said land was set apart to John McBee by commissioners appointed by the probate Court of said County , at the June Term AD 1857, which said tract of land is described as follows, to-wit; known as division No. 4, beginning at the E. corner of No. 3, made for R.McBee at a stake in Robert McBee’s field notes for bearing trees; Thence N. 45 degrees W. 342 vrs, to the W. corner of Silas P. McBee division of 700 acres of land from which all the divisions are taken, see field notes of said tract for bearing trees; Thence S. 45 W. 3300 vrs. to a stake; Thence S. 45 E. 342 vrs. to stake in prairie the W. corner of division No.3: Thence N. 45 degrees E. 330 vrs to the beginning. Together with all and singular the rights, members and appurtenances to the same in any manner belonging or appertaining thereto and I the said J.G. McBee will and my heirs and legal representatives shall the said premises unto the said John P.Groom, warrant and forever defend against the claim or claims of any and all persons whomsoever. This conveyance is intended as a trust for the better securing F.M. Hobbs, in the payment of a certain promissory note of Forty Nine and 96/100 dollars made by me the said J.G. McBee with interest at 12 ½ per annum from date payable to the said F. M. Hobbs or bearer bearing even date with these presents and to become due Ninety days after the date thereof upon the payment of which said promissory note with the interest thereon accrued together with the expenses herein accrued, being well and truly made this grant is to become void but in case of default in the payment of the same at the maturity of said note the said John P. Groom is then or at any time thereafter by these presents authorized and empowered upon the request of the said F.M. Hobbs to sell said tract of land at the Court House Doors at Canton, Texas in said County therein complying in all respects with the requirements of the law in selling under execution issued out of the District Court and thereafter to make good and sufficient titles to said tract of land to the purchaser of purchasers thereof with the usual covenants and warrants to receive the proceeds of said property therein sold and the same to apply to the payment to of said promissory note the interest thereon accrued and expenses thereon incurred holding the residue if any there be subject to the order in the said J.G.McBee and I the said J.G. McBee do hereby ratify and confirm any act or acts of the said John P. Groom by him lawfully done in the premise.
