Huger of Charleston, South Carolina, acting through my Attorney in Fact H.M. Trueheart, of Galveston, Texas, under Power of Attorney dated 20 September 1881, party of the first part in consideration of One Hundred and Sixty Dollars, to me paid and Secured to be paid by Thomas White of Van Zandt County, Texas as follows, Eighty Dollars to me paid in cash the receipt of which I hereby acknowledge and said White’s promissory note of even date have with payable to my order at Office of H. M Trueheart 160 Galveston, Texas for Eighty Dollars one year after date with interest at the rate of ten percent annum from January 5th 1882 until paid, and payment secured by deed of Trust of even date herewith on the following described Land have granted bargained and sold and do here by grant, bargain, sell, alien convey and confirm unto the said Thomas White party of the Second part his heirs and assigns forever , Lot No. One of the Subdivision of 640 acres of Land lying and Situated in Van Zandt County, Texas on the waters of the Sabine River West of the Cherokee boundary line. Patented to James Hamilton assigns, February 9th 1846, by Patent No. 381, Vol. 1. According to the Plan of the Survey and Subdivision thereof by T. J. McKain, Surveyor, made in December 1881, said Land Lot No. One contains Forty acres of Land and is bounded as follows; Beginning at the SE corner of said James Hamilton 640 acre Survey No. 11, whence a P.O. 25 in diam. Brs. N. 34 degrees W. 20 vs a P.O. 20 in. diam. Brs. S. 32 degrees W. 10 vs. Thence N. 45 degrees W. 150 vs a branch 475 vs to stake for corner. Whence a P.O. 16 in. diam. Brs. N. 77 degrees W. 4 6/10 vs a P.O. 15 in. diam. Brs S. 33 degrees E. 7 6/10 vs. Thence S. 45 degrees W. 475 vs to stake for corner, whence a BJ 7 in. diam. Brs. S. 68 degrees E. 5 6/10 vs. B.J. 4 in. diam. Brs S. 1 1/9 degrees W. 13 8/10 vs. Thence N. 45 degrees E. 475 vs stake in SE Line of said Hamilton Survey for corner a PO 20 in. diam. Brs N. 36 degrees E. 8 vs. Thence N. 45 degrees E. 475 vs to the Beginning a Plot of said Subdivision being hereto attached and made part of the conveyance to have and to hold all and Singular the above described and conveyed premises and property with all the rights privileges , hereditaments and appurtenances thereunto belonging or in anywise appertaining unto the said Thomas White party of the second part his heirs or assigns forever and to the said party of the first part do hereby bind myself and my heirs executors and administrators unto the said party of the second part his heirs and assigns that I will seized of all and singular the said property and premises that I have good right and lawful authority to make this sale and conveyance of the same, that the said Property and Premises are free and clear of full and every encumbrance and that unto the said party of the Second part heirs and assigns I and my heirs executors and administrators will forever warrant and defend the same against all adverse lawful claim or claims whatsoever. It is provided and agreed that said White shall assume and pay Taxes on said forty acres of land for the year 1882 also that said Trueheart is not personally liable under the foregoing warranty.
