Scroggins, of the County of Van Zandt and State of Texas, the receipt whereof is hereby acknowledged do hereby give, grant, bargain, sell and convey unto the said Nancy J. Scroggins, her heirs and assigns forever a certain tract of land described and bounded as follows: Being part of survey No.106 in the name of Wm. H. McBee and being part of the petitions which was set apart to Silas P. McBee by the commissioners appointed by the Probate Court of Van Zandt County in said State of Texas at the February Term 1854. (The Report of said commissioners was approved at the March Term 1854 of said Court) to partition and divide the Estate of Wm. H. McBee, deceased. Among his heirs; and being part of the partition which was set apart to heirs of Rebecca Roberts by the Commissioners appointed (by the Probate Court of Van Zandt County in the aforesaid State) in the June Term of 1857 and the report of said commissioners was approved at the August Term 1857 of the aforesaid Court to partition and divide the Estate of Silas P. McBee, deceased, among his heirs. Beginning 743 varas S 45 degrees W from a (?) 732 varas, W. from the East Corner of Survey No.106, in the name of Wm. H. McBee: Also beginning 743 S. 45 degrees W. from the North corner of a (200) two hundred acre Tract of which the freed notes and other particulars are described in the report of the Commissioners that was appointed at the August Term of the Probate Court of Van Zandt Count 1857 (which report see) . Thence R. 45 degrees E. 75 varas to stake for corner; Thence N/W. 45 degrees E. 75 varas to stake for corner; Thence N. 45 degrees W. 75 varas to stake for corner; Thence P. 45 degrees W. 75 varas to the place of beginning, including the McBee Graveyard, which is on the North side of the Creek that is generally known as the McBee Creek. With all the privileges thereto belonging; To have and to hold the afore grants a promise to the said Nancy J Scroggins, her heirs and assigns, to her and their use and behalf forever. I the said Henry L Karber, for myself my heirs, executors and administrators, do (covrnans?) with the said Nancy J Scroggins, her heirs and assigns; That I am lawfully seized in fee simple of the afore granted premises; That they are free from all encumbrances; that I have good right to sell and covey the same to the said Nancy J. Scroggins, as aforesaid; and that I will and my heirs executors and administrators shall warrant and defend the same to the said Nancy J. Scroggins, her heirs and assigns forever against the lawful claims and demands of all persons whatsoever. Witness my hand and seal using Scroll for Seal, this the 21st day of December A.D. 1869.
