The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgenwebarchives.org *********************************************************************** Book O, Pages 735, 736; 20 October 1871 Robert McBee to Nancy J McBee-Scroggins Warranty Deed; State of Texas ] Van Zandt County ] Know all Men by these presents, That I Robert McBee, of the County and State aforesaid in consideration of the sum of ($10.00) Ten dollars, to me paid by Nancy J Scroggins, of the above named County and State, the receipt whereof is hereby acknowledged, do hereby give, grant, bargain, sell and convey to the said Nancy J Scroggins, her heirs and assigns forever, a certain tract of land described and bounded as follows: Being part of Survey No. 106, in the name of Wm. H. McBee, and being part of the partition which was set apart to Silas P McBee by the commissioners appointed (by the Probate Laws of Van Zandt County, (-------------------------------sentence between lines is unreadable--------------------------), in said State of Texas.) at the February Term 1854, of said Court to partition and divide the Estate of Wm. H McBee, Deceased, among his heirs. And being part of the partition which was set apart to Robert McBee by the commissioners appointed (by the Probate Court of Van Zandt County in the aforesaid State) at the June Term 1857. (and the report of said commissioners was approved at the August Term, 1857, of the aforesaid Court to partition and divide the Estate of Silas P McBee, deceased, among his heirs at law. Beginning 743 varas S. 45 degrees W. from a point which is 732 vars W. 45 degrees W. from the East corner of Survey No. 106, in the Name of Wm. H. McBee. Also beginning 743 varas S. 45 degrees W. from the East corner of W. (100) one hundred acres tract set apart to Robert McBee of which the field notes and other particulars are described in the report of the Commissioners then appointed at the August Term of the Probate Court of Van Zandt Co., 1857. (which report see). Thence N. 45 degrees W. 178 varas to stake for corner; Thence N. 45 degrees E 75 varas to stake for corner; Thence S. 45 degrees E. 178 varas to stake for corner; Thence S. 45 degrees W. 75 varas to stake for corner, as the place of beginning including 210/100 acres of land. Said land lies on the north side of a creek that is generally known as McBee Creek which is a tributary of the Sabine River, with all the privilege there to belonging to have and to hold the afore granted premises to the said Nancy J Scroggins, her heirs and assigns, to her and their use and behalf forever. I the said Robert McBee, for myself, my own executors, and administrators, do covenant with the said Nancy J Scroggins, her heirs and assigns, that I am lawfully seized in fee simple of the above granted premises, as they are free from all encumbrances, that I have good right to sell and convey the same to the Said Nancy Scroggins as afore said and that I with my heirs, executors and administrators shall warrant and defend the same to the said Nancy J Scroggins, her heirs and assigns forever against the lawful claims and demands of all persons what ever.
