FORM A For Use of Soldiers Who Are In Indigent Circumstances THE STATE OF TEXAS County of Wilson I,Jack Sutherland, do hereby make application to the Commissioner of Pensions for a pension to be granted me under the Act passed by the 33rd Legislature of the State of Texas, and approved April 7, 1913, on the following grounds: I enlisted and served in the military service of the Confederate States, in Hoods Texas Brigade in Brazoria, during the war between the States of the United States, and that I did not desert the Confederate service, but during said war I was loyal and true to my duty, and never at any time voluntarily abandoned my post of duty in the said service. That I was honorably retired from active service on account of wounds on March 24th, 1865, and ordered to report to Brig. Gen. Roberts in Texas, was delayed on route by the "Sruash Up" -- and surrendered to the Yankees at Denopolis about July 1865 -- and they gave me transportation to Texas. that I have been a bona fide citizen of this State since prior to January 1, A.D. 1900, and have been continuously since a citizen of the State of Texas. I do further state that I do not hold any National, State, city or county office which pays me a salary or fees of $300 per annum, nor have I an income from any other employment or other source whatever that amounts to $300.00 per annum, nor do I receive from any source whatever money or other means of support amounting in value to the sum of $300 per annum, nor do I own in my own right, nor does any one hold in trust for my benefit or use, nor does my wife own, nor does any one hold in trust for my wife, estate or property, either real, personal or mixed, either in fee or for life, of the assessed value of over one thousand dollars, exclusive of a home of the value of not more than $1000.00; nor do I receive any aid or pension from any other State, or from the United States, or from any other source, and that I am not an inmate of the Confederate Home, and I do further state that the answers given to the following questions are true: 1. What is your age? 76 2. Where were you born? Wharton County Texas Jan'y 26, 1838 3. How long have you resided in Texas? all my life 4. In what county do you reside? Wilson 5. How long have you resided in said county, and what is your postoffice address? In Wilson County since 1949. P.O. address Floresville. 6. Have you applied for a pension under the Confederate pension law and been rejected? Have never applied before this. If rejected, state when and where. 7. What is your occupation, if able to engage in one? Land surveyor when able to work. What is your physical condition? Feeble. 8. In what State was the command in which you served organized? Texas. 9. How long did you serve? Give, if possible, the date of enlistment and discharge. nearly 4 years. 10. What was the letter of your company, number of battalion, regiment or battery? "F" 4th Texas Infantry (Hoods Brigade} until promoted, adjutant of brigd. 11. If transferred from one command to another, give time of transfer, name of command and time of service. Transferred to Texas Reserve when retired at Richmond March 24, 1865. 12. What branch of the service did you enlist in -- infantry, calvary, artillery or navy? Infantry, served continuously until wounded & d-- in Oct 1864. 13. If commissioned direct by the President, what was your rank and line of duty? Private in Co. F, 4th Inf. until commissioned as Adjt of the 4th Texas Infty. 14. If detailed for special service, under the law of conscription, what was the nature of your service and how long did you serve? Never detailed on any special duty. 15. What is the assessed value of your home, if you own a home? Don't own a home. 16. What is the assessed value of your other property? A buggy & horse & a fiddle constitute my worldly possessions, with value over $100. 17. Have you transferred to others any property of any kind for the purpose of becoming a beneficiary under this law? No. Wherefore our petitioner prays that his application for a pension be approved and such other proceedings be had in the premises as are required by law. Mayes, County Judge of Wilson County, State of Texas, on this day personally appeared R. W. Murray and J. B. Polley who are personally known to me to be credible citizens, who being by me duly sworn, on oath state that they personally know Jack Sutherland, the above named applicant for a pension, and that they personally know that the said Jack Sutherland has been a bona fide resident citizen of the State of Texas since prior to January 1, A.D. 1900, and that they have no interest in his claim. THE STATE OF TEXAS County of Wilson Before me, E. D. Mayes, County Judge of Wilson County, State of Texas, on this day personally appeared R. W. Murray and J. B. Polley who are personally known to me to be credible citizens, who being by me sworn, on oath state that they are personally acquainted with the foregoing applicant, and that the facts set forth and statements made in his application are correct and true, to the best of their knowledge and belief, and that they have no interest in his claim, and said applicant's habits are good and free from dishonor. And they further make oath to the following facts touching the applicant's service in the Confederate Army: (State fully your source of knowledge.) We enlisted and served in the same company and regiment with the said Jack Sutherland, and except when we or he were temporarily absent from command, met him daily. From our own knowledge and from his own statements and those of our other comrades in the company, we know that he was a gallant soldier and bore a brave part in the battles of Eltham's Landing (or West Point), Seven Pines, Secnd Manassas, Boonesboro Cap, Sharpsburg (or Antietam), Fredericksburg, Seige of Suffolk by Longstreet, Gettysburg, Chickamauga, Wauhatchie, Siege of Knoxville by Longstreet, The Wilderness, Spottsylvania C.H., North Anna, Coal Harbor, Bermuda Hundreds. In the trenches at Petersburg, Capffin's Farm -- Sept 29, 1864 -- New Market Heights, Charles City Road, and Darbytown Road, and that he was wounded at said last battle. We further state that in June 1864, he ws promoted from the ranks to the post of Adjutant of the Fourth Texas Regiment, was every inch a soldier until disabled, and has since the war been an honorable, law-abiding citizen. Stevenson, State and County Assessor in the County of Wilson, State of Texas, do certify that Jack Sutherland, or his wife, or his trustee, or trustee for his wife, whose name is signed to the foregoing application for a pension, under the Act of the Thirty-third Legislature, approved April 7, 1913, is charged on the tax rolls of said county with a homestead of the value of $1000 (The Homestead belongs to my children, I live with them) Dollars, and of other property, real or personal, or both of the value of fifty (50) Dollars. Given under my hand this 22nd day of January A.D.1914 (signed) C. B. Stevenson State and County Tax Assessor. APPLICATION FOR MORTUARY WARRANT STATE OF TEXAS County of Wilson I, Annie B. Sutherland, do hereby certify that I am the person to whom is entrusted the paying of the accounts and indebtedness of the late Jack Sutherland, who was a pensioner of the State of Texas, and whose file number is 28697 and whose original county is Wilson. The said pensioner Jack Sutherland, died on the 16th day of December, 1922, in the town of Floresville, County of Wilson, Texas. The pensioner died in the home of himself, who was related to the pensioner as . That the warrant, which application is hereby made for, shall be applied to paying all or part of the expenses incurred by the said pensioner Jack Sutherland. I further certify that the warrant for the current quarter has not been cashed by the pensioner, or the best of my knowledge and belief. I am related to the pensioner as daughter and that my home is in the town of Floresville, County of Wilson State of Texas, that my postoffice address is Floresville. (signed) Annie B. Murray , do certify that I am an undertaker in the town of Floresville, County of Wilson, State of Texas that I had charge of the body of Jack Sutherland, who died in the town of Floresville, County of Wilson, State of Texas, on the 16th day of December, 1922. That said body was prepared for burial by me on the day of December, 1922. That said body was buried in the Sutherland Springs Cemetery, which is located in the County of Wilson, State of Texas, and that I am of the opinion that warrant herein applied for should be issued to the said Miss Annie Sutherland, who makes the foregoing application. Sparks, M.D., do certify that I am a practicing physician, and that I attended Jack Sutherland in his last illness, and am of the opinion that his ailments were chronic bronchitis. I further certify that I am of the opinion that the Mortuary Warrant above requested should be issued in the name of the aforementioned applicant, in accordance with Act passed by the Thirty-Fifth Legislature, and approved March 2, 1917.
