We command you to summon Jrehonius? Yancey administrator of Isaiah Humphrey ____ deceased. to appear before the Justices of our County Court of Albemarle at the Courthouse on the first Monday of November next to answer a Bill of Injunction in chancery exhibited against him in our said Court by Elijah Brown and this he shall in no wise emit and have then there this writ. Witness Alexander Garrett Clerk of said Court this seventh day of October 1816 in the 41st year of the Common wealth. Alex Garrott CC (First line cut off) in memory sitting your orater Elijah Brown respectfully represents to your worships that some two or three years since your orater was _________ to a certain John Wood in a certain some of money by open account who drew a draft in _____ of a certain Isaiah Humphrey for the sum of 50$ which draft your orater accepted and proceed to pay the sum of two pounds 7/10. But sudden ________ and death prevented his making the proper credits that in certain Jechonias Yancey administrator in the estate of said Humphrey and ____ sixty has been ____ in the accepted order and ____ to a judgment and executor without marking the proper ____ for 27___ which sum your orater was unable to establish at the ___ at law. He therefore prays that the judgment and ___ may be ____ for the sum of 27__ and the said Yancey us administrator. Know all men by these presents that we Elijah Brown and Tallon Brown are held and firmly bound unto Jeconais Yancey administrator of Isaiah Humphrey decd in the just and full sum of five pounds fifteen shillings and eight pence to be paid to the said Jeconias Yancy administrator of aforesaid his certain attorney, his heirs, executors and administrators, to the payment whereof well and truly to be made, we bind ourselves and each of us, our and each or our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this 7th day of October 1816. This condition of the above obligation is such that whereas the above bound Elijah Brown hath obtained from the country Court of Albemarle an injunction to stay all further proceedings on a judgment obtained in eh said Court by the said Jeconais Yancy admin of Isaiah Humphrey declared against Elijah Brown and John H. Brown for $154 72 cents to be discharged by the payment of $77 72 cents with interest whereon from the 1st Dec 1815 ___ paid for debt and 554 cents costs so far as ____the sum of 27 10? pounds. until further order of the said County Court now if the above bound Elijah Brown and Tallon Brown do and shall well and truly pay and satisfy the judgment and costs aforesaid and also all such other costs, damages and charges as shall be awarded by the said County Court in case the injunction aforesaid shall be dissolved then the above obligation to be void or else to remain in full force and virtue.
