(containing one hundred and seventy four and three fourths acres) together with all the appurtenances thereunto belonging or in any wise appertaining to have and to hold the aforesaid lands together with the appurtenances unto the said Thomas Whittaw his heirs and assigns to the only proper use and be ___of him the said Thomas Whittaw his heirs and assigns forever ?of? the aforesaid David Humphrys for himself his heirs, Exrs and administrators doth Covenant and agree with said Thomas Whittaw his heirs and assigns that the said David Humphrys and his heirs and the aforesaid mentioned land with the appurtenances unto the said Thomas Whittaw his heirs and assigns against him the said David Humphrys his heirs Exrs and administrators assigns against all other persons whatsoever will warrant and forever defend. To have and to hold the said tract or parcel of land with its ?appurtenance? to the said David HUMPHREY SR. and his heirs forever. In witness whereof the said William H. Cabell esquire, governor of the commonwealth of Virginian hath here unto set his hand and caused the ?legal? seal of the said commonwealth to be affixed at Richmond on the 5th day of June in the year of our Lord one thousand eight hundred and six.
