It also speaks of the Revolutionary War Service of HIS FATHER - ISSAC NICHOLSON, of VA who served from Surry Co., NC also. of Surry County (later Stokes). There is no mention of wife nor children, but in his later years he was in the guardianship of a 24 year old man named Edward H. Moore. §§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§§ State of North Carolina Stokes County On the 5th day of October 1844 Personally appeared before me Edmond L. Martin, a Justice of the Pease and qurater [illegible] in and for the county aforesaid aged 82 years and being first duly sworn according to the Law doth on his oath, make the following declaration in order to attain the benefit of the Act of Congress, passed June 7th 1832 that he entered the Service of the United States as a Volunteer and served as herein after stated (Viz) he was a resident of the county of Surry, (now Stokes), NC. He left his home with his father Isaac and he was a regular soldier in the service of the United [States] at home on fulow as well as he can remember about the year 1781 and [illegible] with the said Isaac to Duplin Court house NC where the army was then stationed and there joined the troops as a volunteer to Capt. [whose] name that I was enrolled with I do not now recollect. Though a man by the name of Rayford was our Major, the [other?] name of the eighty I cannot recollect. and after stying then some time the army was divided and my father Isaac was sent some where near Charleston South Carolina and I staill remained at Duplin Court house. And afterwards was taken by our Major Rayford as a servant or a Trainer of our horses, and frequently [illegible] and [illegible] was they for our [illegible] from that time untill the close of the war, which was as well as I now recollect 15 months from the time I joined the army at which time my father being discharged come by after me when we returned home together. To [illegible] now [illegible] when I now line and name [illegible] the agency was I was unsur and that of our [illegible] [illegible]Major Rayford Captain Hauley, Rice and Lamb. and Col. name as well as I can recollect was Tinson McRea, I was not in any engagements neither was the troops where I was stationed that I now can recollect. I was marched from Duplin Court House to a little village by the name of Elizabeth Town where I was takin sick and left by the main army where I remained for some time before I obtained my health sufficient to do duty though on the recover of my health, I again returned to my duty and performed the Service required of me untill the close of the war. When I was honourably discharged, and the army was disbanded for further information he [illegible] [illegible] the department to the [illegible] affadavit he hereby reliquishes every claim whatever to a pension or annuity Except the present, and declares that his name is not on the Pension roll of the agency of any State as (If any) only on tht of the agency of the State of N.C. Sworn to and Subscribed the day and year aforesaid E.L. Mortin J. P. I was born in the County of Albemarle, Virginia the year I don't recollect . Have you any proof of your years of age, if so where is that. Answer: I have none Question 2. Where were you living when called into the Service, Where have you lived since the revolutionary war, and where as you now live Answer I was living in Surry County, NC, now Stokes, When I went into the Service and still live in said county. Question 4[sic] How were you called into the service, were you drafted, did you volunteer or were you a Substitute, and if so for whom Answer I volunteered Question 5 State the names of some of the officers who were with the troops where you served Answer the name of the officers and General circumstancy[sic] of my service is set forth in the body of the declaration. With the exception of Capts. Rhody and McRea Question 6 did you ever receive a discharge from teh service and if so by whom was it given and what has become of it Answer I rec'd a discharge at the close of the war (I think Major Rayford give it to me, at Duplin Court House or was there, I cannot exactly recollect, as the army was disbanding and [illegible] their discharges at various points ) which has since ben lost or misplaced. Question 7 state the name of Persons to Whome[sic] you are known in your present neighborhood and who can Testify to your character for varacity and their belief of your service as a soldier of the Revolution Wm M. Pursey and Wm Wood- John Sawyer The applicant further states that it would be a great deal of trouble and expense to attain the certificate of a clergyman as there is no one acting in that capacity in his neighborhood and that from Bodily infirmity he is not able to go to court to make that declaration without very much endangering his health Which is very delicate. To the Truth of which I concur. E.L. Martin J.P. (signature) The applicant further states that the cause of his not applying for a pension sooner was that he had intended to [illegible] and live without it. But from old age and infirmity he has been compelled to ask aid from that country for which he served. We the assigined to certify that we have been personally acquainted with James Nickleston for some 39 years. As for Wood - 15 or 20 years and believe him to be a soldier of the revolution as he has set forth in his declaration. A man of varacity and truth and that he was a solider of the revolution we never heard it disputed. Given under out hands and seals the day and state first asaid[sic] here E. L. N. page 85 ____________________________________________________________ State of North Carolina County of Stokes § On this the 2nd day of April AD one thousand eight hundred and fifty five personally appeared before me a Justic of the peace within and for the county and State aforsaid Edward H MOORE, aged twenty 4 [sic] years a resident of the county of Stokes in the State of North Carolina who being duly sworn according to Law declares that he is the lawful guardian of James Nickleston who was a private in a company commanded by Captain [blank] in the [blank] regiment of [blank] Commanded by Col. [blank] in the war of the Revolution that his ward, the siad James Nickleston is now a Revolutionary pensioner of the United States at the Rate of $52, 68 as will respectfully appear by reference to the sid Jas Nickleston pension certificate on file at Washington City in Book E Vol 6/2 page 69 and dated on teh 21st day of Feb AD 1853 which he thinks is conclusive proof of his ward's service said was he makes this declaration to obtain the bounty land to which his ward, the said James Nickleston may be entitlled[sic] under the act approved march the 3rd AD 1855. He also declares that he has not received a warrant for bounty land under this or any other act of Congress nor made any other application therefore. Ed H MOORE [signature] [another word follows the signature that looks like grand- but not clear enough to be sure] We, Elisha SMITH and T BLACKBURN, residents of the County of Stokes in the State of North Carolina upon our oaths declare thus the foregoing Know all men by the presants that I James Nicholson of the County of Stokes State of North Carolina do hereby constitute and appoint George C. Ames of Washington DC my true and lawfull attorney for me and my name to examine into and present my claim for any amt [sic] of Resolution and pension which may be due and I hereby authorize my said agent an attorney to examin all the papers and diversments[sic] in relation to said claim- on file in the department at Washington City [illegible] to file additional evidence and to do all things that I [illegible] cant do if personally present- Hherby certify if and confirm as all that my said [illegible] in attorney shall lawfully do in the [illegible]- witness my hand & seal this 23rd March 1852 signed sealed and § delivered [illegible] of § James [his mark] Nicholson [drawn seal] R J WADE State of North Carolina § County of Stokes § The 23rd day of March 1852 before me the subscribed a Justice of the Peace in all for said County personally appeared James Nicholson and acknowledged the foregoing power of attorney [illegible] his act and [illegible] In testimony whereof I have here to set my hand this day in the above matter.
