I James Harris of the County of Albemarle and Parish of Fredericksville being in common health and of perfect sound mind & memory thanks be to God for the same but calling to mind the uncertainty of life and the certainty of death and knowing that it is appointed for all men to die do make and ordain this my last will and testament hereby revoking and disannulling all other wills and testaments heretofore by me made and this only to be my last will and testament. First my will and desire is that all any just debts together with my funeral expenses to be paid out of my estate and as for such worldly goods wherewith it has been pleased God to bless me with dispose of them in the manner and form following Imprums(?) I leave unto my beloved wife Betsey Harris all my estate both real and personal for and remaining the term of her natural life or widowhood she making no waste thereof only for her own support and at my wifes death or marriage I give unto Betsey Mills five shillings also to my daughter Caty Owens five shillings current money and then the balance of my estate to be sold on a reasonalbe credit borth real & personal and the money arising from such sale to be equally divided among my children towit Henry Harris, William Harris, Peter Harris, James Harris Blake Harris, Wiley Harris and the children that are then living of my daughter Sarah Jones is to have one equal part of my estate to be divided among them so as the whole of the children of my daughter Jones has no more among the whole of them than are then living that are one of the rest of my children hers for his own part and the children of my daughter Mary Owings that are then living the same as my daughter Sarah Jones’s chldren, the children of my Nancy Owens that are then living the same as my daughter Maring Owings children and if any of my children before mentioned should die whithout lawful issue then my will and sesire is that their part should be equally divided amoung the rest of my children and grandchildren as before mentioned. Betsey Mills and Caty Owings excepted. Lastly I nominate and appoint my sons Henry Harris, William Harris, Blake Harris and David Owings executors of this my last will and Testament Signed sealed subscribed and preserved by the said James Harris to be his last will and testament this tenth day of August 1796 In presence of Rob.
