The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net Albemarle Co Virginia Will bk 6 pg 314 HUMPHREY, David IN the name of God amen, I David Humphrey of the County of Albemarle, being in perfect health and sound mind and memory, and being desirous of distributing the little estate that, I have been blessed with, at the time, it may please God to call me hence, I do hereby make the following disposition to wit: first I lend unto my beloved wife, Jane Humphrey, the whole of my estate both real and personal during her life and it is my desire, that she should keep my negro girl Judy particularly in the house, to work and wate upon her, and not to be kept at any other business. Secondly I give my son David Humphrey the tract of land he now lives on, also at the death of my wife my negro girl Juda. Thirdly, I give unto my son Isaiah Humphrey, the remainder of my land also my negro girl named Mary at the death of my wife. Fourthly my will and desire is that at the death of my wife the whole of my personal estate which I have lent my wife which shall be then remaining together with the increase thereof sold or other wise equally divided between the whole (?of) my children, my son Davy excepted (to wit) Kerziah (or Herziah) REYNOLDS, Mercy (or Merry, or Mency) Humphrey, Anny Rice (or Rive), Molly SPENCER, Milley BAILEY, Patsey FOSTER, Liddy BABER and Isaiah Humphrey and if any of my said last mentioned children should die before the death of my wife the part I leave them to be equally divided between the whole of my children the part of my estate that would by the foregoing disposition to Liddy Baber and in case of her death before my wife to her children my will and desire is that the said part be rested in M. John FIELD as a trustee in order that the aforesaid purposes be faithfully fulfilled as my will and desire is that no person whatever receive any benefit or have any right title or interest in the same but the said Liddy Baber and her children in case of her death as aforesaid which is the reason that I have left the said legacy as aforesaid to the said John Field. Fifthly I leave to my granddaughter Sally HALL a bed and furniture provided she does not get one from me during my life. And lastly I do hereby constitute and appoint my sons David Humphrey and Isaiah Humphrey my executors and I do hereby publish and declare this to be my last and testament hereby revoking and disannulling all will or wills heretofore made. In witness whereof I set my hand and seal this day of 1805. This Instrument of writing purporting to be the last will and testament of David Humphrey deceased was produced into Court and John Rife, a subscribing witness thereto being charged to affirm to the earth saeth that the signature of his name as a witness to the said Will is the hand writing of him the said John Rife that he has no recollection at this time of the signature or acknowledgement of the said David Humphrey to or of the said Will, but verrily beleaves he never would have signed the same as a witness without seeing such signment or hearing such acknowledgement and it appearing further to the Court from legal evidence that James Brooks and James Taylor the other two subscribing witness to the said Will have departed this life and the hand writing of the said James Brooks being proved by the oath of Robert Brooks It is orderd that this will be recorded.
