These same restrictions apply where this work is posted on the RootsWeb message boards at Ancestry.com. http://www.usgwarchives.net ************************************************************ Will of John MARTIN; Albemarle County, Virginia; Will Book 5; Page 200 In the Name of God Amen; I John Martin of Albemarle County and parish of St. Anne, being in perfect health mind and memory, but well aware of the great uncertainty of all human perfection, do make and ordain this my last will and Testament (hereby revoking all others) in manner and form as follows. To wit That is to say imploring him, in the first place, who is the fountain of all good and the benign giver of all earthly & heavenly blessings, to accept my immortal Soul as the only return can be made him for all his great Goodness towards me and Secondly requesting my body to be buried in a decent christianlike manner and all necessary charges paid out of my estat. Item I will thereafter, all the rest of my worldly estate as follows. In the first place it is my will and desire, that all my just debts be paid. after which I will and bequeath unto my beloved wife Elizabeth, during her widowhood, my plantation whereon I now live with the present Mansion house & curteleges thereunto belonging to be laid off, by the following boundaries (Viz). Beginning on the top of the noted Mountain called Dobbens's Mountain, opposite and in the Direction of the present Dividing fence between my Mansion house and the plantation whereon my son Benjamin Martin now lives running thence a Straight line to the said Dividing fence thence with the said fence to another fence, which runs about a South west course thence along said fence untill it Strikes a branch of Hardware, thence up the said branch to the line of the tract of Land Benjamin Martin purchased of Jno. Cosby Senr. thence along the lines of said land to the aforementioned Mountain thence along the top of the same to the Beginning. Item I give and bequeath unto my said wife upon the same conditions, and term of Widowhood the following Slaves Viz. Ned and Hannah his wife Patience, Ben, Rachel, Warner and Matilda - also the whole of my household and Kitchen furniture also three horses and Eight cows to be choosed by herself als [sic] One half of my Stock of Hogs, and the choice half of my Stock of Sheep. Item I give and bequeath to my said wife during her life the following Slaves to wit Harrett Sarah Louisa Revely and a child named Nancy and their Increase Subject to the payment of One hundred and five dollars to my son Benjamin and at her decease I will & bequeath the said Negroes Harriet, Sarah, Louisa, Revelly and Nancy together with their increase to my wifes niece Elizabeth Minor Masting. to her and her heirs forever- Item I give and bequeath to my Daughter Sally Watson wife of John Watson the following Negroes "To wit" Mary Amey, Garland & Lucy his wife together with their increase to her and her heirs forever-. Item I give and bequeath to my Daughter Mary Wood wife of William Wood the following negroes "To wit" Jacob Jim and Lewis to her and her heirs forever. Item I give and bequeath to my Daughter Susanna Jacobs (wife of Hickson C. Jacobs) a negroe boy named Anthony to her and her heirs forever. Item I give and bequeath to my Daughter Clarissa One negroe boy named Peter, during her natural life and Should She die with out legal issue, then my will is that the said negroe shall be returned to my son Benjamin and his heirs. Item I give and bequeath to my grandson John Martin a negroe boy named Lendrick [?] to him, and his heirs forever Item I give and bequeath to my grandson Lindsay Martin a negroe boy named Jack to him and his heirs forever. Item I give and bequeath to my Grandson Benjamin Martin a negro boy named Richmond: to him and his heirs forever Item I give and bequeath to my Granddaughter Elizabeth Martin a negroe boy named Squire, to her and her heirs forever: Item I give and bequeath to my wife Elizabeth during her widowhood my Waggon & Gear. Item it is my will and Desire that my executors shall a lot to my wife a Sufficient quantity of grain and other provisions necessary to maintain her untill she can make a crop and grow Sufficient for Seeding. Item I give and bequeath to my son Benjamin after my Decease thee whole of My estate both real and personal not heretofore bequeathed together with the whole of the estate both real and personal which is already bequeathed to my wife Elizabeth (during her widowhood, after her death or Marriage including the increase of the same to him and his heirs forever. Lastly I constitute and appoint my son Benjamin Martin, and my friend William Woods the whole and Sole executors of this my last will and Testament.
