Beginning at a corner White oak in the said Christopher Ford's line thence east 69 poles to Main Road, thence up the said road North 49 West 56 Poles to a bend in the Road, thence along road North 45 West 43 Poles thence South 69 poles to the Beginning. Whereas a marriage is shortly intended to be solemnized between the above named John Bartholemew Dupee and Mary Ford and whereas the said John Bartholemew Dupee and Mary Ford have this day promised and agreeded to and with each other to the purpose and effect following to wit that the five following slaves (to wit) Peter, Lucy, Betty, Rachel and Julius, whereof the said Mary is now possessed shall after the said marriage shall take effect be and remain to the use of the said John Bartholemew Dupee and Mary during their joint lives and afterwards to the use of the survivor during his or her life. That the said John Bartholemew Dupee shall suffer the said Mary anytime after the said marriage to make a will and thereby dispose of the said slaves or any of them in such manner as she shall think proper reserving to him the said Dupee the use of the said slaves during his life-That in case the said marriage shall take effect and the said Mary shall survive the said John Bartholemew Dupee that the said Dupee will leave her houses and plantations wherein he shall then --- with land sufficient to work her said slaves on and wil also leave her household furniture and other chattles as to value of those she is now possessed of and which the said Dupee may become entitled to by virture of the said marriage. That the said Mary in case of her surviving the said Dupee shall claim nor take no part of the estate which the said Dupee shall be possessed of or Interested in at the time of his death akes right of Dover? or otherwise other than the land and Chattels herein before mentioned. Now know ye that the said Mary Ford for and in Consideration of the Agreement aforesaid and of the Sum of five shillings Current Money to me in hands paid by the said Christopher Ford before the Sealing and Delivery hereof Have Bargained and sold and by these presents and Bargain and sell unto the said Christopher Ford and to his Heirs and Assigns the Slaves aforesaid to wit Pear, Lucy, Betty, Rachel & Julius & their future increase to have and to hold the said slaves and every of them and their said increase unto the said Christopoher Ford his Heirs and Assigns to and for the the several uses Trusts intents and purposes following, That is to Say, to the use of the said Martha until the said marriage shall take effect & from and after the solmnation thereof to the use of the said John Bartholemew Dupee and Mary during their joint lives and after the death of either of them then to the use of the survivor and from and after the death of the survivor then to the only use and behoof of such Person or Persons to whom the said Mary shall give and bequeath the said slaves or any of them and their increase by her last will and testament in writing and the said Dupee in consideration of the marriage agreement before mentioned and of the sum of 5 shillings to me in hand paid by the said Christopher Ford do for myself, my Heirs, executors and administrators covenant and agree to and with the said Christopher Ford as trustee for the said Mary that I will after the said marriage shall take effect quietly suffer and permit the said Mary in due form of law to sign seal publish and declare her last will and testament in writing and in and by the same to give will and bequeath or otherwise dispose of at her free will and pleasure unto such person or persons as to her shall Seem meat and convenient all or any of the slaves aforsaid and their increase reserving to myself as herein before mentioned the use of the said slaves during my life and I do hereby further covenant and agree that I will buy Last Will and Testament the said Mary in case she shall survive me the house and plantation wherein I shall and will at the time of my death with land sufficient to work her said slaves. To hold during her life and also that I will give her household furniture and other chatels to the value of those I may recieve with her to hold to her use during life--And I the said Christopoher for and in consideration of the several matters and things herein before mentioned and also for the sum of five shillings to me in hand paid by the said John Bartholomew Dupee do covenant and agree to and with the said Battholomew Dupee that in case the said marriage shall take effect and the said marriage shall the said John Bartholomew, that then the said Mary shall not claim, ask, demand take or receive any part of the estate of which the said John Bartholoomew shall be possessed or interested in at the time of his death real or personal as her right of Dover? or otherwise nor claim Right of Dowrver? in any Land or slaves of which the said Dupee is now possessed may at anytime hearafter be possessed nor claim any part of his estate other than the Land and Chatels which the said Dupee hereby covenanted to give her by his will. And we the said John Bartholomew Dupee and Christopher Ford for the faithful performance of all and every the Covenants agreements, articles, and clauses herein before mentioned which on our Respective Parts ought to be done and performed Do Bind ourselves, our heirs, Executors and Administrators each to the other in the penal Sum of Five hundred Pounds Current Money firmly by these presents in Witness whereof the parties to these presents have hereunto set their hands and seals the 26 day of September 1765. Wit: that for & in consideration of the sum of 110 Pounds Current Money the said Henry in hand paid by the sd Christopher Ford before the Sealing & Delivery of these Presents the receipt is hereby acknowledged, He the sd Henry Street Have Granted, Bargained ,sold, aliens & confirms by these Presents Do grant, Bargain, sell, alien & confirm unto the sd Christopher Ford, his heirs & assigns One Certain Tract or Parcel of Land containing 630 acres lying & being in the Co of Amelia Lying & being between the Branches of Flatt Creek & Stecks? Creek known by the name of Cobbs Ordinary, the Sd land lyes on both sides the main Road & was Granted by Patent to Samuel Cobbs, Gent, bearing date the 12 day of Janurary 1746 Which 638 acres of Land was conveyed to the sd Henry Street by Judith Cobbs, Widow & Retict of the sd Samuel Cobbs by Deed bearing date the24 day of May 1759 which will more fully appear of record in the County Court aforesaid. With all woods, waters, houses, buildings, Profits, Commodities & appurtenances thereunto belonging or any wise appurtaining or known to be part or parcel thereof according to the known Ancient & reputed bounds of the Same & the Revision & Revisions, remainder & remainders thereof and all the Estate right, Title or interest of him the said Henry Street of the Same. To Have & to Hold all & Singular the appurtenances to the said Christopher Ford, his Heirs & Assigns. To the only proper use & behove of him the said Christopher Ford, his heirs, Assigns forever & the said Henry Street for himself & his heirs doth Covenant & Grant to the sd Christopher Ford , his Heirs & Assiogns forever that he the said Henry Street & his Heirs the said Land & premises with the appurtances to the said Christopher & his heirs & assigns against the Lawful claim & demand of all & every Person & Persons whatever & shall & will Warrant forever, Defend by these Presents.
