BEGINNING at a Poplar on the head of Bearskin Swamp, then running along a line of marked trees to a pine a Corner tree on the Indian Creek, thence down the said Creek to a Gum, thence along a line of marked Trees at the edge of the said Bearskin Swamp and from thence to the first station. And the Reversion and Reversions, Remainder and Remainders, Rents and Profits thereof TO HAVE AND TO HOLD the said Tract of land and Premises with the appurtenances unto the said Thomas Booth his heirs and assigns forever and the said John Spell and Elizabeth his Wife their Heirs Execution and Administration the said Tract of land together with all the appurtances to the said Thomas Booth his Heirs and assigns will forever here after Warrant and defend. WITNESSETH that the said John Spell and Elizabeth is Wife for and in Consideration of the sum of one hundred pounds proclamation to them in hand paid the receipt whereof they do hereby acknowledge Have given granted Bargained & Sold and by these present do give grant bargain & sell alien infease and confirm unto the said Thomas Booth his Heirs and assigns one certain Tract or parcel of land Situate in the county of Edgcombe on the North side of Tarr River Beginning at a pine then N 45 degrees West 128 poles to a red Oak on Tarr River thence N 45 degrees East 200 Poles to a pine thence S 45 degrees East 128 Poles to a maple in a pond then N 45 Degrees West 200 Poles to the first Station and continuing by Estimation one hundred and sixty acres and the Reversion & Reversions Remainder and Remainders Rents and Profits thereof To Have and Hold the said Tract of Land an Premises with all the appurtenances unto the said Thomas Booth his Heirs and assigns and to the only proper use and Behoof of the said Thomas Booth his Heirs and assigns forever and the said John Spell and Elizabeth his wife have hereunto set their hands and Seals the day and year first above Written and delivered in the presence of Jas Hass/Hall, John Hall, Benj Booth John Spell (SEAL) her Elizabeth X Spell (SEAL) mark North Carolina Edgcombe County November Court 1772 The Execution of the within deed was in open Court duly acknowledged. Ordered to be registered Test Edward Hall C.C. _____________________________________________________________________ Deed Book 2, Page 76 Edgecombe County, North Carolina Mitchell to Booth THIS INDENTURE made this seventeenth day of April in the year of our Lord one thousand seven hundred and seventy Three BETWEEN Isaac Mitchell and Mary his wife of the County of Edgecombe and province aforesaid of the one part and behalf & Thomas Booth of the said county. WITNESS that they the said Isaac & Mary his wife hath for & in consideration of the sum of fifty pounds Virginia money to them in hand paid at or before the Ensealing of delivery hereof, by him the said Thomas Booth the receipt whereof and every part thereof is hereby acknowledged and they themselves therewith fully satisfied contented and paid and he the said Thomas Booth of every part Thereof doth acquit and discharge forever hath given granted bargained Sold Released aliened conveyed and confirmed unto him the said Thomas Booth his Heirs Executors Administrators & assigns forever one mosuage or tract of Land containing by Estimation Fifty Acres be at the same more or less and being the plantation whereon the said Isaac Mitchell & Mary his Wife now live situate being and being in the county of Edgcomb and on the South side of Tar River. BEGINNING at the mouth of the Mill Grist thence up the River to a Hickory marked and from thence aline of marked Trees to a Sweet Gum in the fork of a Branch and from thence aline of Marked Trees to a Branch thence down the Branch to a Sweet Gum in Lamuel Suggs line thence aline of marked trees to alive oak thence down the mill grist to the finish Station containing fifty acres more or less with all buildings Grounds Woods and underwoods standing and growing upon the Premises and all ways ----- profits commodities and appurtenances who so ever therein to belonging or in any wise appurtaining and the Revision and Revisions remainder and Remainders thereof in all and Singular the Premises with all and every there incidents & all Evidence Writings Measurements of or concerning the said Land or Premises TO HAVE OR TO HOLD the said tract or parcel of land with all and Singular the Premises before mentioned ment or intended to be hereby granted with all and every other appertenances unto the said Thomas Booth and to his heirs and assigns for the only use and behoof of him the said Thomas Booth and of his heirs and assigns forever from the said Isaac Mitchell & Mary his Wife and their Heirs the said tract or parcel of Land and allow Singlular the Premises herein before mentioned with the appertenances unto the said Thomas Booth his Heirs and Assigns to his and their own proper use against the challenge claim and demand of all persons whatsoever shall and will warrant and forever defend. Deed Book 3, Page 302 Edgecombe County, North Carolina KNOW all men by these Present that I John Booth of Amelia in Virginia for & in Consideration of Five Shillings to me in hand paid doth remise Release Confirm & make over unto James Booth, Benjamin Booth & Robert Booth of Edgecombe County in N Carolina all the Rights, Title, Interest, Claims or Demand of any short which he the said John Booth hath might have or ought to have of in & to certain Land in Edgecombe County late the property of Thomas Booth, dec Father of the above said Parties agreeable to & conformable to the Will of the said Thomas Booth, Reference being had to the said Will may more fully appear the meaning of the said John Booth is to confirm the Devises mentioned in his Said Fathers Will touching his real estate to them the said James, Benjamin, & Robert Booth & their Heirs forever. IN WITNESS whereof the said John Booth hath hereunto set his name and Seal this 25th Day of February Anno Dom 1778. Witness his hand Feb 24, 1778 Witness: O Davis John Booth The copy of the original deed that I have does show Robert Booth in the beginning but then switches to John Booth. John signed the deed. Deed Book 3, Page 422 Edgecombe County, North Carolina THIS INDENTURE made the fifth day of April in the year of our Lord One thousand seven hundred and seventy nine Between Robert Boothe of the County of Amelia & State of Virginia of the one part and Benjamin Booth of the County of Nash in the State of North Carolina of the other part. WITNESSETH that the said John Boothe for and in Consideration of the Sum of fifty pounds prod money to him in hand paid the receipt wherefore doth hereby acknowledge Hath given granted bargained & Sold these presents do give grant bargain and sell alien convey and confirm unto the said Benjamin Booth his Heirs & Assigns forever a certain Tract or parcel of Land, whereon the said Benjamin Booth formerly lived situate in the County of Edgcombe on the South side of Tarr River beginning at the mouth of the Mill Grist thence up the River to a Hickory marked and from thence aline of marked Trees to a Sweet Gum in the fork of a Branch and from thence along a line of marked Trees to a branch thence down the Branch to a Sweet Gum in Lamuel Suggs line and thence aline of marked trees to a live Oak from thence down the Mill Grist to the beg Station containing fifty acres more or less with all the buildings cleared ground & woods and underwoods standing and growing upon the premises and all Ways agreements profits commodities and appertances whatsoever thereunto belonging and in any wise appertaining and the Reversion & Reversions Remainder and Remainders thereof in all and Singular the promises with all of every their indicinces? and all Evidences Writings Measurements of or concerning the land and Premises TO HAVE AND TO HOLD the said Tract or parcel of Land with all & Singular the premises herein before mentioned ment or intended to be hereby granted with all and other the appurtenances unto the said Benjamin Booth and to his Heirs and assigns for the only use and behoof of him the said Benjamin Booth & of his Heirs & assigns forever from the said John Booth and his Heirs the said Tract or parcel of Land and all and Singular the premises here before mentioned with appurtenances unto the said Benjamin Booth his Heirs and assigns to his and their own proper use against the Challenge Claim and demand of all persons whatsoever shall and will warrant and forever defend IN WITNESS whereof the said John Booth has hereunto set his hand and affixed his Seal the day and year above mentioned. John Booth (SEAL) Signed Sealed and delivered in presence of Arch White, John Barber, James Booth Edgcombe County May Court 1779 The Execution of the within deed of Sale was duly proved in open Court by The Oath of Arch White one of the subscribing witnessess thereto. Deed Book 5, Page 530 Edgcombe County, North Carolina Bond of John Booth KNOW all men by these present that I John Booth of the County of Amelia in the State of Virginia am held & firmly bound unto James Booth, Benjamin Booth & Robert Booth of the County of Edgcombe in the State of No Carolina in the Sum of one Thousand pounds to which Payment will and truly to be made unto the said James, Benjamin and Robert Booth their Heirs and Assigns. I bind myself, my Heirs, executors, & administrators firmly by these present Sealed with my Seal and dated this 25 day of Feb 1778. Whereas Thomas Booth late of the County of Edgcombe aforesaid in the state of North Carolina aforsaid made a Certain writing calling the same his last will and Testament & Therein and thereby divided all his Lands in the County and State aforsaid between his Sons the said James, Benjamin and Robert but failing to so particular as the Law require in making The said Writing so that after the death of the said Thomas the said Writing could not be proved as his last will & Testament whereby for the Invalidity thereof all his Lands aforsaid came by decent unto the above bound John Booth as Heir at Law to the said Thomas Booth but the said John Booth not wishing to so under act his said Father's intention did for diverse Good Causes him there unto Moveing-did release and make over to his said Brothers James, Benjamin and Robert all his right title & interest of in and to the Lands of their said Father, but for want of time the Instrument of release not being so full as it might have been he is known to all Men by these present that If the said John Booth his Heir or assign shall whenever he or they shall be requested by the said James, Benjamin and Robert Booth their Heirs or Assigns make and execute to them a Good and Sufficient Deed in fee Simple for the Lands aforsaid without Guile or deceit such as one as their Council learned in the Law shall devise the same warranting and defending only against the said John Booth his Heirs or assigns. Then the above Obligation to be void otherwise to remain in full force and Virtue.
