All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Bob Ellis http://www.genrecords.net/emailregistry/vols/00017.html#0004075 November 29, 2008, 4:01 pm Written: June 15, 1750 John Ellis Deed to John Foster 1750 This indenture made this fifteenth day of June in the year of our Lord Christ One Thousand Seven Hundred and Fifty between John Ellliss Indian Trader of the county of Amelia of the one part and John Foster of Gloucester County of the other part, Witnesseth that the said John Elliss for and in consideration of the sum of Two Hundred Pounds current money of Virginia to him in hand paid by the said John Foster the receipt whereof he the said John Elliss doth hereby acknowledge hath given granted bargained and sold and by these presents do give grant bargain sell and confirm unto the said John Foster his heirs and assigns forever a certain Tract or parcel of land containing one thousand and sixty six acres lying and being on Flat Creek in the County of Amelia aforesaid the same being Granted the said John Elliss by a Pattent bearing Date the Thirtieth day of June One Thousand Seven Hundred and Forty Three and is bounded as follows (to wit) Beginning at a corner White Wallnut on the Creek thence West forty Degrees North forty poles to a Corner Hickory thence North three Degrees East twenty two poles along Motleys line to Tanners Corner Pine thence West thirteen Degrees North two hundred and twenty five poles to John Crawfords line thence along his line South twenty five Degrees West fifty two poles to his corner thence West twenty five degrees North one hundred and forty eight poles to his corner thence South twenty five degrees West four hundred and six poles to a Branch of the North fork, thence down the said Branch as it meanders to the mouth thereof thence up the said fork as it meanders to a Corner Haeberry on the south side thereof. Thence thirteen degrees, West thirty poles to John Mayes’ corner crooked White Oak thence East five degrees North three hundred and ten poles along Mayes’ line to his corner thence North twenty degrees East eighty seven poles to Motleys lines thence West eight poles along his line to his corner birch on Flat Creek thence down Flat Creek as it meanders to the beginning together with all waters, woods, houses, foences, orchards and all other improvements thereon being to have and to hold the said land and the appurtenances thereunto belonging or in anywise appertaining unto the said John Foster, his heirs and assigns forever and the said John Elliss doth for himself and his heirs covenant and agree with the said John Foster that he the said John Elliss and his heirs the above granted land and promises with all its right and privileges unto the said John Foster his heirs and assigns against all and every person or persons warrant forever defend. In witness whereof the said John Elliss hath hereunto set his hand and seal. his John ( Î ) Elliss (Seal) Mark Seal William Baldwin Memorandum, that on the fifteenth day of June One thousand seven hundred and fifty, livery and seisin of the within mentioned land and promises whereby acknowledged to be by the within named John Elliss to the within named John Foster according to the form and effect of the within deed. his John ( Î ) Elliss (Seal) Mark At a court held for Amelia County the fifteenth day of June 1750 John Elliss presented and acknowledged this his deed with the livery of seisin endorsed to John Foster in order to be recorded. Lucy, the wife of the said John Elliss, being privately examined relinquished her right of dower in the land conveyed by the said.
