To all to whom these presents shall come; Greetings. Know ye that for the consideration and hereafter mentioned we have given, granted and confirmed and by these presents for us, our heirs and successors do give, grant and confirm unto HENRY FARLEY one certain tract or parcel of land containing nine hundred and two acres lying and being in the County of Amelia on the upper side of the Flatt Creek and on both sides of Mayes Branch in the same county and bounded as followeth, to wit. Beginning at WILLIAM JACKSON’s upper corner on Mayes Branch thence along his lines east two hundred and fifteen poles to his corner oak thence south twenty one degrees east eighty five poles to a corner dutch elm then up Flat Creek as it meanders to RICHARD JONES’ lower corner red oak thence along his lines north forth three degrees west one hundred and twenty six poles to his corner in oak thence west twenty degrees south one hundred sixty two poles to a corner thence south twenty two degrees east one hundred and fourteen poles to faced corner thence west thirty eight degrees south one hundred and four poles along PHILIP JONES’ head line to a corner white oak by OSBOURNE’s path thence west seventy six degrees north one hundred and four poles to WILLIAM SIZEMON’s line thence along the same east thirty five degrees north twelve poles to his corner thence along one other of his lines north thirty five degrees west one hundred and seventy eight poles to a corner in the same thence north one hundred and eight poles to a corner lightwood knott in a valley on the lower side of Mayes Branch thence east one hundred and twenty five poles corner thence north twelve degrees east one hundred and fourteen poles to a corner white oak thence east seventeen degrees south one hundred and forty three poles to a corner thence east forty two degrees south one hundred and twenty four poles to a corner pine thence south thirty degrees west one hundred and forty three poles to the beginning three hundred and eighteen acres past of the said tract being formerly granted unto the said HENRY FARLEY by our Letters Patent bearing date the twentieth day of August one thousand seven hundred and forty and five hundred and eight four acres the residue thereof being formerly granted unto SAMUEL COBBS by our Letters Patent bearing the date the twelfth day of September one thousand seven hundred and thirty eight and by him sold and conveyed unto the said HENRY FARLEY. With all woods, underwoods, swamps, marshes, long grounds, meadows, fieldings and his due revenue of all veins, mines, and quarries as well discovered as not discovered within the bounds aforesaid and being part of the said quantity of three hundred seventy six acres of land and the rivers, waters and water causes therein contained together with the privileges of hunting, hawking, fishing, fowling and all other profits and commodities and hereditaments amends whatsoever to the same or any part thereof belonging or in anywise appurtaining. To have and to hold, possess and enjoy the said tract or parcel of land and all other the before granted premises and every part thereof with their and every of their appurtenances with the said HENRY FARLEY and to his heirs and assignees forever. To the only use and behoof of him the said HENRY FARLEY his heirs and assignees forever. To be held of these heirs and successors use of our Mannor of East Greenwich in the County of Kent in free and Common Soceage and not in Capites or Knight’s Service. Yielding and paying unto our heirs and successors for every fifty acres of land and so proportionably for a lessor or greator quantity than fifty acres the fee rent of One Shilling yearly to be paid upon the Feast of Saint Michael the Arch Angel and also cultivating and improving thence acres part of every fifty of the tract above mentioned within three years after the date of these presents provided always that if three years of the said free rent shall at any time be in arrears and unpaid or if the said HENRY FARLEY his heirs or assignees are not within the space of three years next coming after the date of these presents cultivate and improve three acres part of every fifty of the tract above mentioned then the estate whereby granted shall cease and be utterly determined and thereafter it shall and may be lawful to and for us our heirs and successors to grant the same lands and premises with the appurtenances unto such other commoner persons as we our heirs and successors shall think fit. In witness whereof we have caused these our letters patent to be made. Witness our trusty and well beloved William Gooch, Esquire, Lieutenant Governor and Commander in Chief of our said Colony and Dominion at Williamsburgh under the seal of our said Colony the thirteenth day of July One Thousand Seven Hundred and Forty Two.
