To all whom these Presents shall come Greeting Know Ye that for divers good causes and consideration but more especially for and in consideration of the sum of Five Pounds Ten Shillings of good and Lawful money for our use paid to our Receiver General of our Revenues in this our Colony and Dominion of Virginia we have given granted and confirmed and by these presents for us our Heirs and Successors do give grant and confirm unto John Ellis one certain Tract or Parcel of Land containing One thousand and eighty five acres lying and being in the County of Amelia on both sides of the Horsepen Creek in the forks of Nottoway River adjoining Munfords, Bollings, and Smarts lines and bounded as followeth, to wit, Beginning at Bollings corner Hiccory on the South side the said Creek Thence along his line West five Degrees South ninety nine Poles to his corner Thence South twenty seven Degrees West ninety three Poles to a corner Shrube white Oak Thence South thirty three Degrees East one hundred and seventy seven Poles to Munfords corner white Oak Thence along his line East one hundred and forty eight Poles crossing the Creek to his corner Hiccory Thence North thirty six Degrees East two hundred and forty Poles to a faced corner thence North ten Degrees West two hundred and eighty Poles to a faced corner Thence East sixteen Degrees North one hundred and fifteen Poles to a faced Thence North eight Degrees West two hundred and ten Poles to a faced corner Thence West six Degrees North eighty Poles to Smarts corner Hiccory Thence along his line West twenty eight Degrees South three hundred and eleven Poles to Bollings line Thence along his line South East two hundred and two Poles to his corner White Oak Thence South thirty three Degrees West one hundred and sixty Poles to his corner on the Horsepen Creek Thence down the Creek as it Meanders to the Beginning – With all Woods Underwoods Swamps Marshes Lowgrounds Meadows Feedings and his due share of all Veins Mines and Quarries as well discovered as not discovered within the boundaries aforesaid and being part of the said Quantity of One thousand eighty five Acres of Land and the Rivers Waters and Water Courses therein contained together with the Privileges of Hunting Hawking Fishing Fowling and all other Profits Commodities and Hereditaments whatsoever to the same or any part thereof belonging or in any wise Appertaining To have hold Possess and Enjoy the said Tract or Parcel of Land and all other the before Granted Premises and every part thereof with their and every of their Appurtenances unto the said John Ellis and to his Heirs and Assigns forever To the only use and behoof of him the said John Ellis his Heirs and Assigns forever To be held of us our Heirs and Successors as of our Manner of East Greenwich in the County of Kent in free and common Toccage and not in Capite or by Knights Service Yielding & Paying unto us our Heirs and Successors for every fifty Acres of Land and so proportionably for a lesser or greater Quantity than fifty Acres the Fee Rent of one Shilling yearly to be paid upon the Feast of Saint Michael the Arch Angel and also cultivating and Improving three Acres part of every fifty of the tract abovementioned within three years after the date of these Presents Provided always that if three years of the said Fee Rent shall at any time be in arrears and unpaid or if the said John Ellis his Heirs or Assigns do not within the space of three years next coming after the date of these Presents Cultivate & Improve three Acres part of every fifty of the Tract abovementioned Then the Esate hereby granted shall Cease and be Utterly Determined and thereafter it shall and may be lawful to and for us our Heirs asnd Succesors to Grant the same Lands Premises with the Appurtenances Unto such other Person or Persons as we our Heirs and Successors shall think fit. In Witness whereof we have caused these our Letters Patent to be made Witness our Trusty and Well beloved William Gooch Esq. our Lieutenant Governor and Commander in Chief of our said Colony and Dominion at Williamsburgh Under the Seal of our said Colony the twenty second Day of September one thousand seven hundred and thirty nine in the thirteenth year of our reign.
