Garland and Wife to Henry, George, and James Clark This indenture made this 7th day of October in the year of our Lord 1822 between David S. Garland and Jane, his wife, of the said County of Amherst of the one part and Henry Clark, George Clark, and James Clark of the other part and all of the said County of Amherst, Virginia, witnesseth that the said David S. Garland and Jane, his wife, for and in consideration of the sum of $4,267 to them in hand paid by the said Henry Clark, George Clark, and James Clark before the selling and delivery of these presence the receipt of which is hereby acknowledged have bargained, sold, and released unto the said Henry Clark, George Clark, and James Clark and their heirs, assigns, one full and equal third part of a certain tract or parcel of land lying and being in the State of Ohio in the County of Delaware and on Futon Creek and between the Scioto and Little Miami Rivers containing 4,267 acres which said tract or parcel of land was granted to James Claibourne, Robert R. Claibourne, Sterling Claibourne, and Lucy Wright in consideration of military services of their Father, Butler Claibourne, deed and was located by virtue of a military warrant which in the whole for 5,333-1/3 acres which said 4,267 acres was surveyed on the 21st day of July in the year of our Lord, 1809, and the said Robert R. Claibourne having departed this life intestate, the said James Claibourne, Sterling Claibourne, and Lucy Wright became entitled of the whole of the aforegoing said tract or parcel of land to be equally divided between them or their legal representatives, share and share alike which would entitle them to 1,422-1/3 acres of equal value of the residue of the tract and t0he said Sterling Claibourne having sold to the said David S. Garland one-third part of said tract or parcel of land which will more fully appear by the said Sterling Claibourne and Jane, his wife, deed bearing date the 10th day of August in the year of our Lord 1816 and recorded in the Clerks Office in Delaware County in the State of Ohio. The 14th day of September 1816 which said tract or parcel of land containing 4,267 acres, bounded as follows to wit. Beginning at a hickory, elm, and ash southwest corner to Jonathan Clark's Survey 5750 running South 72 East 640 poles crossing the creek at 220 poles to two elms and an ash southeast corner to William Isaac Cruthers Survey 7008 thence with their lines and the cross thereof North 18 deg West llll poles crossing a branch at 140 poles to large tranch at 226 poles and the creek at 300 poles passing Cruthers \northeast corner at 800 poles to two sugar trees and a buck thence North 84 deg East 910 poles to two hicories and an elm Northwest corner to the said Clark's survey thence with his lines South 3 deg East 948 poles crossing a branch at 166 one at 504 and one at 668 poles to the beginning. To have and to hold the one full and equal third part of the above description tract or parcel of land with all singular the appurtenances of the said Henry Clark, George Clark, and James Clark and heirs and assign which will be 1,420-1/3 acres of equal value with the residue of the tract to be held and conveyed free from the let hindrances (meles talson?) of all and every person or persons of the said David S. Garland and Jane, his wife, for their selves, their heirs, executors, and administrators will warrant and forever defend the same against the claims of all and everyone wahtsoever in witness wherefore the said David S. Garland and Jane F., his wife, party to the annexed deed bearing date the 7th day of October 1822, personally appeared before us in our said county aforesaid and acknowledged the same to be their act and deed and desired us to certify the same to the Clerk of Amherst to be by him certified to the Clerk of Amherst to be by him certified to the Clerk of Delaware County in the State of Ohio in order that the same deed may be there recorded.
