Witnesseth that whereas James McAlexander Decd. in his life time was possessed of a Bond of John Ward of Bedford County to James Alexander Sen. of Amherst County for two Thousand Acres of Land in Pitsylvania County, State of Virginia which bond he conveyed to his Sons William & John & the said James McAlexander Decd. Devised to his Son James twenty eight Acres of Land in Amherst County on the waters of Davises Creek & the said James McAlexander departed this life in January 1798 Intestate leaving four heirs (viz) James McAlexander, William McAlexander, John McAlexander, Alexander McAlexander the son of said James Decd. & the sd. James decd. seized (?) in fee simple of six Tracts of Land containing five hundred & Eighty five Acres lying in Amherst County on Davis's Creek. & the sd. James McAlexander one of the heirs of James Decd. was not satisfied with the Seventy Acres as a full proportion of his fathers Land have brought the seventy Acres into hog pot & the said Alexander McAlexander one of the Sons & heirs of James Decd. having paid the said James McAlexander one hundred & fifty pounds Current money of virginia for his right of the five hundred & Eighty five acres of Land mentioned in this Article and the said James having a right to one fourth of the personal Estate of the said James McAlexander Decd. have bargained & Sold it to the said Alexr. McAlexander for fifty pounds current money of Virginia & the said James McAlexander doth for himself his heirs Exrs. & assigns (?) to Relinquish to the sd. Alexander McAlexander all the right & title to the said Estate of his father Jas. McAlexander decd. and the said William & John McAlexander sons & heirs of the said James decd. having Concurred that they have received their part of their fathers Landed Estate, doth for themselves their heirs Exrs. Do Covenant to & with said Alexander McAlexander for the sum of five Shillings to them as a Consideration have agreed to Relinquish all their Right & Title to the said five hundred & Eighty five Acres of Land mentioned in this Article in witness whereof the Parties have set their hand & Seals the day & year above written. Napier + P S William McAlexander for himself his heirs etc. for the Consideration of sixty Pounds Current money of Virginia hath Bargained & Sold & by these presents doth Relinquish & Deliver unto Alexander McAlexander & his heirs & forever all his claim right & Title of his father James McAlexanders decd. personall Estate in witness whereof he hath set his hand & seal this twenty third day of Augt. one thousand seven hundred & ninety nine Teste Wm. This Indenture was acknowledged in Court by James & John McAlexander parties thereto and as to them ordered to be recorded & proved by the Oaths of William McDonnald and M. C. Napier as to William McAlexander & as to him ordered to lie for further proof and at a Court held for the said County the 19th day of October 1801. This Indenture was further Proven by the oath of Micajah Burnett as to Wm. McAlenander another Witness thereto & ordered to be Recorded.
