I Solomon Carter being in perfect health desires and dispose of my worldly estate and as followeth Vz. Item, I give to my son William Carter the land on which he now lives and all the land joining it on the waters of Buflo also a horse one feather bed and cow which he has already received. Item, I give to my son Abraham Carter a tract of land on the water of Buflo on the Tuck Mountain one horse one feather bed & one cow the horse has been received. Item, I give to my daughter Milla Davis one feather bed and a cow which she has received. Item, I give to my son Peter Carter half the land where I now live to be equally divided betwixt him and my son Elisha also one horse one feather bed and cow and one years schooling to be paid out of my estate. Item, I give to my daughter Salla Carter one feather bed one cow and saddle. Item, I give to my son Elisha Carter the half of the land where I now live to be equally divided betwixt him and my son Peter Carter also one horse one feather bed and one cow also years schooling to be paid out of my estate. Item, I leave to my daughter Nancey Carter one feather bed one cow. Item, there is two Negroes named Jupiter and Chloe it is my desire they should be sold and be equally divided betwixt my three youngest children to raise and educate them at the discretion of my executors. Item, the remainder part of my estate both real and personal it is my desire to be sold and equally divided amongst all my children. Item, I leave to my wife Maryann Carter one shilling to be paid out of my estate. Item, whereas my wife has left me and cohabits with another man if she should have any children after this I leave to them one shilling to be paid out of my estate. I do appoint my brother Peter Carter and my son Abraham Carter my executors of the last will and testament as witness whereof I have hereunto set my hand and seal this 7 day of February, 1784. Solomon Carter (his mark) Test: William Tucker David Crawford At a court held for Amherst County the second day of October 1786. This last and will and testament of Solomon Carter, Decd, was presented in court by Peter Carter one of the executors therein named & proved by the oath of David Crawford a witness thereto & continued for further proof. And at a court held for aforesaid county the fifth day of February 1787 this will was further proved by the oath of William Tucker and ordered to be recorded and Peter Carter & Abraham Carter the executors with William Tucker & John Crawford their security acknowledged bond according to law and took the oath required by law. Test. Wm Loving, Clk. Page 89-92 Amherst County VA - Will of Eliot Roberts, 1788 Will Book 3 p.89-92 p. 89 In the name of God Amen the Eighth Day of April One thousand seven hundred and Eighty eight. I Eliot Roberts of the County of Amherst being week in Body but in Perfect memory and remembrance do make and ordain this my Last Will and Testament in manner and form following Viz: first I bequeath my soul into the Hands of Almighty God hoping that through the meritorious death and suffering of my great redeemer to receive free pardon and forgiveness of all my sins and my body to the grave to be buried in christian burial at the discretion of my executors hereafter nominated, as for my worldly goods whoom is has been pleasd (sic) God to bestow upon me I give and bequeath in manner and form following Viz I give to my son Zachariah Roberts all the different tracks (sic) of land ajoining (sic) the track whereon he Lives namely all the Land which is or has been deeded or conveyed to me on Richfish (or Rickfish) River joining Mathew HARRIS and the land of John MORRISON deceased. I give to my son John ROBERTS my Track of Land lying on the head of Buck Creek bought of Joseph MONTGOMERY. I give to my son Mathew ROBERTS my Plantation and the different Track of Land adjoining the platation whereon I now live. I give to my son HENRY ROBERTS threee hundred pounds specie to be raised out of my estate during his minority and to be paid unto him on his coming of age. I give each of my daughters Elizabeth THOMAS, Frances ROBERTS, Susanna ROBERTS and Ann Roberts a small negro and horse and saddle and feather bed and furniture to them and their heirs lawfully begotten, and I give to each of my sons John Roberts, Henry Roberts and Matthew Roberts a horse and saddle and feather bed and furniture. I give to my daughter Sarah Thomas and to her heirs lawfully begotten four negros namely Peter, Mol, Jeny and Rose they being the negros which John THOMAS has now in his possession. p. 90 (I did not copy)(There probably are other heirs.) p. 91 Revoke and my will is that my Brother Henry Roberts and my wife Elizabeth Roberts have it in their Power to divide and give to Either of the Legatees their parts at any time that they (namely my Brother Henry Roberts and my wife Elizabeth) shall think proper for that purpose, and I do by these presents make good and confirm anything whatsoever that they shall think proper to do inbehalf or for either of the legatees withinmentioned. As witness my Hand and seal the date above mentioned. Eliot (his mark) Roberts. Witnesses Richard Farrar, Thomas Buknell (Bucknell?), Thomas Farrar, Cornelius Murrell, Leonard Phillips. At a court held for Amherst County the first Day of September 1788, this last will and Testament of Elliott Roberts deced. Was presented in court and proved by the oath of Richard Farrar a witness thereto and ordered to be for further proof. And at a court held for the aforesaid county the sixth Day of October 1788 this will was further proved by the oath of Cornelius MURRELL witness thereto. Whereupon Henry Roberts, Zachariah Roberts and John Roberts Executors herein named with William Harris and Charles IRVING their securities entered into and acknowledged bond on the penalty of four thousand pounds and took the oath required by law and ordered to be recorded. Test. Wm. Loving, Clk. Know all men by these presents, that we Henry Roberts, Zachariah Roberts, John Roberts, William Harriss and Charles Irving are held and firmly bound to William CABELL, James DILLARD, Daniel MAYS, and Benjamin RUCKER Gent. Justices of the court of Amherst County, now sitting in the sum of five thousand pounds. To the payment whereof, will and truly to be made to the said Justices, and their successors, we bind ourselves, and each of us, our, and each of our Heirs, Executors and Administrators, jointly and severally, firmly by these presents. I Joseph Mays Senr. of Amherst County and the state of Virginia being of sound Mind and Memory although weak of body and knowing the uncertainty of life make this my last Will and Testament; revoking all my former wills hereto-fore made, recommending my Soul to Almighty God the father of Spirits, and my body to be buried according to the Rites of the Church, in hopes of a blessed resurection through the merits of Jesus Christ. My desire is that all my just debts be paid and whatever remains of such worldly Substance as God hath pleased to endow me with to be disposed of after my decease in manner and form -following. Item I give and bequeath to my son John Mays a negro girl named Winney to him and his heirs forever. Item I give and bequeath to my son James Mays a negro girl named Moll to him and his heirs forever Item I give and bequeath to my daughter Lydia Mays the wife of James Walters a feather Bed and Furniture to her and her heirs forever Item I give and bequeath to my sons Joseph Mays and Elijah Mays a Tract of Land Containing three hundred and seventh acres more or less being in the County of Amherst and lying on the waters of Juniper Creek to them and their heirs forever. Item I give and bequeath to my daughter Jemima Hollingsworth a negro girl named patt to her and her heirs forever. Item I give and bequeath to my son Jesse Mays the tract of land whereon he now lives containing one hundred and fifty acres -- (more or less) to him and his heirs forever, also a negro girl named Luck to him and his heirs forever. Item I give and bequeath to my son Charles Mays a negro Girl named Dinah, also a Tract of Land containing two hundred and fifty acres lying on the waters of Tye River to him and his heirs forever. Item I give and bequeath to my son Elijah Mays his equal part of the Land above mentioned lying on Juniper Creek, also a Negro Girl named Cate to him and his heirs forever. Item I give and bequeath to my Son Robert Mays, three negroes (to wit) Fann Milly and Nick a Feather Bed and furniture a horse called Whistler also two hundred and fifty acres of Land adjoining Charles Mays Tract. Item I give and bequeath to my son Moses Mays five negroes (to wit) Ben Charlotte Fill(? Can't read this name) Charles and Nan, a feather Bed and furniture to him and his heirs forever. Item: I give and bequeath to my son Lewis four negroes Nell Jim Young Lucy and Will a Feather Bed and furniture also a horse called Lorrel and a saddler and bridle to him and his heirs forever. I also give and bequeath to my Son Robert Mays besides what I have bequeath to him as above a Negro named Stephen to him and his heirs forever Item I give and bequeath to my beloved wife Sarah Mays during her widowhood or natural life all my Land whereon I now live containing three hundred and eighty five acres with all its appurtenances also the whole Stock of Cattle Hogs and etc. together with every other moveable not heretofore mentioned and three negroes (to wit) Zack Dafney and old Lucy. I further desire that after my wifes decease my Land with all its appurtenances Mill and etc and the whole Stock of Cattle Hogs and Etc may be possessed by my two sons Moses and Lewis as joint heirs of Land and Etc. to them and their heirs forever. I also desire that after my wife's decease the negros bequeathed to her should be sold and equally divided among my Sons Joseph Elijah Jesse and Charles but it is to be observed that old Lucy is to be disposed of as my Wife shall think proper. I also desire that if Daphney should have any issue after the date of this my Will and Testament that issue should be valued after my Wifes decease and equally among sons Joseph, Jesse, Charles and Elijah. I desire that any just debts be paid by my sons Moses, Robert and Lewis each contributing an equal part. Note that for brevity sake I have hereto ommitted making mention of the Children or issue the negroes (I can't read this word. It begins with an m could be mothers) may now have or may have hereafter be it therefor known that my desire is that the persons to whom they are bequeathed as above should have the issue deriving from the negroes bequeathing to them as above And I do hereby constitute and appoint my good (the following two words are added above the line)and trusty friends: James Edmonds John Dillard and Charles Watts to execute this my last Will and Testament given under my hand and Seal this seventh day of January one thousand seven hundred and ninety seven Submitted by Valerie Burd
