Page 420.--Oct., 1766: Petition unsigned says: Your petitioner was taken prisoner by the Northward Indians in June, 1756, and continued many years among them, since her return with two of her children she has by the industry of herself and children and the Bounty of some Benevolent persons subsisted in the best manner she could. One of her daughters has lately been married and the other can do no more than provide for herself, so that petitioner has lately been reduced to beg Relief from House to House, and as she is now worn out with Old age and Infirmities and Misfortunes, and has become a real object of Charity, begs relief. Page 421.--Case: In 1738 Act was passed for giving incouragement for the settling the Frontiers by which the Inhabitants of Frederick and Augusta were allowed to Pay off and discharge their Public County and Parish Levies and all officers' fees in money for Tobacco at 3 farthings per pound. This Act was made perpetual. In 1748, Act passed allowing every minister then, or that should be thereafter, preferred to any Parish 16,000 pounds tobacco and Cask. In 1752, or thereabouts, the Minister of Augusta Parish Petitioned the Assembly setting forth the allowance made by the Act of 1738 was too small to maintain him and Family, for till then he only received his tobacco at 3/ 4d. per pound, amounting to £50 per annum, upon which an Act passed reciting the one made in 1738 and for the Future allowed him £100 per annum in lieu of the £50. Afterwards, in 1762, or thereabouts, at the same time the King by his proclamation repealed the two Penny Act, repealed the one made in 1752 allowing the minister of Augusta Parish £100 per annum. Now the Question is whether the Act made in 1738, or that made in 1748, is in Force. And if the latter, how is the tobacco to be levied and collected. As the Inhabitants pays all their fees and levies in money. The Gent. whose opinion is desired is requested to peruse the Several Acts of Assembly as the same cannot be properly recited here for want of them, or the exact time when they passed. WILLIAMSBURG, April 3d, 1766. I am of the opinion that the Act of 1748 makes no alteration in the manner of paying the tobacco dues in Augusta, but that the Inhabitants to whom the privilege of paying at 3/ 4d. per pound was given have still a right to Discharge them at that rate. PEYTON RANDOLPH. Received of Mr. Mathews one pound. P.R. I am of the same opinion and think that the Act in 1761 allowing the Officers (?) on their fees does not extend to the Minister's sallary.
