All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.rootsweb.com/~archreg/vols/00012.html#0002870 August 15, 2007, 6:38 pm Written: September 2, 1811 Recorded: November 25, 1811 Augusta County, Virginia Deed Book 37, pages 4-5 Whereas a dispute now exists between John McCune of the County of Augusta & John Alexander, William Alexander & Gabriel Alexander Exrs of James Alexander dec'd, respecting the line between the land of the said McCune and the land devised by their testator by them and whereas the said Parties are desirous to settle the said dispute without resorting to a Court of law it is hereby agreed by & between the said parties, that William Patrick & Samuel Clarke shall determine where the line between the said tracts shall be established and that their award shall finaly [sic] determine the said dispute, and the said Parties legally bind themselves their heirs & exrs & admrs in the penal sum of one thousand dollars to abide by the award to be made in this case by the said Patrick & Clarke. In Witness whereof they have hereunto set their hands & seals the 2d day of September 1811. Jno. McCune (Seal) John Alexander (Seal) William Alexander (Seal) Gabriel Alexander (Seal) Teste James White Gabriel Alexander Memo: It is further agreed by & between the parties to the above writing that the costs attending the settlement of the said dispute is to be equally divided, that is each party is to pay one half. In Witness whereof they have set their hands & seals the day and year aforesaid. Jno. McCune (Seal) John Alexander (Seal) William Alexander (Seal) Gabriel Alexander (Seal) Teste Gabriel Alexander We, William Patrick & Sam'l Clarke the referees within named have on the same day of the date of the within submission in the presence of the parties thereto run the line in dispute and have established the same viz begining at Two white oaks and runing thence South Sixty Six degrees East three hundred & fifty seven poles passing four white oaks which were blocked out[?] situate we believe were original line ???? to two small white oaks & a small black oak bush on the top of a hill six poles North of a cave. In Witness whereof we have hereunto set our hands the 2d Sept 1811. William Patrick Sam'l Clarke At a Court held for Augusta County, November the 25th 1811. This Article of Agreement between John McCune of the one part and James Alexander Exrs of the other part was proved by the oath of Gabriel Alexander a witness thereto and ordered to be recorded together with a memorandum thereto annexed which was proved by the said witness.
