Witnesseth, that whereas Francis Alexander sen'r. late of the said county of Augusta did by his last Will & Testament bearing date the 25th day of April 1792 & recorded in the county court Office of Augusta, devise unto his two sons John & Francis Jun'r a certain tract or parcel of land containing about Two Hundred acres for which he had no conveyance, but which was afterwards to wit, on the 17th day of June 1794, conveyed by William Henderson & Wm. Gillaspie by Robert Findley their attorney in fact as follows, to wit, one hundred acres to the said John Alexander & one hundred acres (the balance) to the said Francis Alexander Jun'r. as will appear by their deeds therefor recorded in the Office aforesaid, and whereas the said John Alexander departed this life intestate leaving the said Francis Alexander, Gabriel Alexander Jun'r., William Alexander, Jennett Alexander (who hath intermarried with John Alexander) & Dorcas Alexander (who hath also intermarried with Augustine Smith) his heirs at law & equally interested in the aforesaid one hundred acres devised and conveyed to him, and whereas the said Francis Alexander Jun'r. afterwards departed this life, also intestate, leaving the said Gabriel Jun'r., William, Jannett & Dorcas his heirs at law, and also whereas the said William Alexander & wife did by their conveyance bearing date the 1st day of December 1802, and recorded in the said Office, convey unto the said Gabriel Alexander Sen'r. the Interest in the one Hundred acres of which the said John Alexander died Seized, & also by their power of attorney bearing date the 17th day ofJuly 1806, authorized William Alexander to sell & convey all their interest in & to two Hundred acres of land on Christians Creek formerly belonging to Francis Alexander sen'r., being the same that was devised & conveyed to the said John & Francis Jun'r., and whereas also the said Augustine Smith & Dorcas his wife did convey all their Interest in & to the said Two Hundred acres unto Charles Yancey, who together with his wife, by their deed dated the 27th April 1807 & also of record in the said office, conveyed the same to the said Gabriel Alexander sen'r. Now This Indenture, Witnesseth that the said Gabriel Alexander sen'r., Gabriel Alexander Jun'r., John Alexander & Jannett his wife, & William Alexander & Betsey his wife by their said attorney for and in consideration of the sum of Four hundred & fifty pounds to them in hand paid by the said James Hamilton (the receipt whereof is hereby acknowledged) have granted, bargained, & sold & by these presents do grant, bargain & Sell unto the said James Hamilton, his heirs & assigns, a certain tract or parcel of land situate on Christians Creek in the aforesaid County of Augusta containing by estimation one hundred acres, be the same more or less, being a part of the same land that was separately conveyed as aforesaid unto the said John Alexander & Francis Alexander Jun'r. & is bounded as follows, to wit, Beginning at a white oak on a ridge on the south side of Christians Creek Running thence North twelve degrees West to the creek, & down the same Eighty six poles to two sycamores on the north west bank of the said Creek, thence North Eighty five degrees West forty one poles to a locust sapling, thence North Thirty six degrees West eighty two poles to a white oak & Hickory on the old line & with the same South Thirty nine degrees West Ninety one poles to three white oaks corner to the said James Hamilton & with his line south sixty eight degrees west seventy poles to a black oak and Hickory, & South Three degrees west to the said Creek & up the same Eighty one poles to a Sycamore sapling on the south bank of the said creek, thence south sixty eight degrees East, seventy seven poles to three pines & North Seventy three & an half degrees East sixty four poles to the Beginning, together with all & singular the appurtenances thereunto belonging or in any wise appurtaining. To have and to hold the said Tract or parcel of land with its appurtenances unto the said James Hamilton his heirs & assigns, to the only proper use & behoof of him the said James Hamilton his heirs & assigns forever, and the said Gabriel Alexander sen'r., Gabriel Alexander Jun'r., John Alexander & Jannett his wife, & William Alexander & Betsey his wife by their said attorney, for themselves, their heirs Exrs & admrs, do covenant with the said James Hamilton , his heirs & assigns, that they the said grantors, their heirs, Exrs & admrs the said tract or parcel of land with its appurtenances unto the said James Hamilton his heirs & assigns against the claim or claims of them the said grantors & their heirs & of all & every person or persons whatsoever shall & will warrant & forever defend by these presents. In testimony whereof the said Gabriel Alexander Sen'r., Gabriel Alexander Jun'r., John Alexander & wife, & William Alexander & wife by their said attorney, have hereunto set their hands & Seals the day and year first above written. William Alexander & wife, & was proved by the oaths of the Witnesses thereto, as to the acknowledgment of the said Gabriel Alexander Jr. & John Alexander & being also acknowledged in court by the said Jennett Alexander wife of said John Alexander, she having been first privily examined and relinquished her dower as the Law directs, is ordered to be recorded.
