Witnesseth that the said John Alexander & Martha his wife for & in consideration of the sum of one hundred & sixty pounds lawful money of Virginia, to them in hand paid by the said Gabriel ??? the receipt whereof is hereby acknowledged, have granted bargained & sold & by these presents do grant bargain & sell unto the [said] Gabriel Alexander his heirs & assigns two several tracts or parcel of land, lying & being in the aforesaid County of Augusta, the first containing two hundred acres and bounded as follows to wit, Begining at a black oak saplin Corner to James Bell's line & runing along the old manor line South East eighty seven & a half Degrees one hundred & fifty six poles to a post and two black oaks and one white oak Grub, thence south two hundred & five poles to one hickory and two white oaks, thence south West sixty seven Degrees sixteen poles to one pine, thence West one hundred & forty poles to three pines, thence with James Bell's line North two hundred & twenty poles to the place of Begining, being the same land that was conveyed by Robert Jamison to the said John Alexander by Deed bearing date the eighteenth day of August, in the year of our Lord one thousand seven hundred & seventy one, and which was duly admitted to record in the 20th day of August 1771, reference being had to the records of Augusta County will more fully appear, the other Tract or parcel of land contains sixty acres and was devised to the said John Alexander by his father's will bearing Date the twenty fifth day of August in the year of our Lord one thousand seven hundred & seventy eight and which was duly admitted to record the Sixteenth day of March in the year of our Lord one thousand seven hundred & seventy nine, the said last mentioned land lies on the south side of the south river joining the plantation of the said John Alexander and William Long, together with all & singular the appurtenances thereunto belonging or in any wise appertaining to have and to hold the said two tracts or parcels of land, with their appurtenances unto the said Gabriel Alexander his heirs & assigns forever to the only proper use & behoof of him the said Gabriel Alexander his heirs & assigns forever. And the said John Alexander & Martha his wife for themselves their Heirs executors and administrators the said two tracts of land with their appurtenances unto the said Gabriel Alexander, his heirs & assigns against the Claim or Claims of the said John Alexander & Martha his wife their heirs, and of all and every person or persons whatsoever shall & will warrant & forever Defend by these presents. In Witness whereof the said John Alexander & Martha have hereunto set their hands & seals on the day & year first above written. Clarke James Allen The Commonwealth of Virginia to John Wayt and William Boys Gentleman Justices of Augusta County Greeting. Whereas John Alexander & Martha his wife by their Certain Indenture of Bargain and Sale bearing date the 29th day of October 1808 have sold & conveyed unto Gabriel Alexander two Certain tracts or parcels of land with the appurtenances lying and being in the County of Augusta, And whereas the said Martha cannot conveniently travel to our County Court of Augusta to make acknowledgement of the said conveyance, therefore we do give unto you or any two or more of you, power to receive the acknowledgment which the said Martha shall be willing to make before you of the conveyance contained in the said Indenture, which is hereunto annexed, and we do therefore command you, that you do personally go to the said Martha and receive her acknowledgment of the same, and examine her privily and apart from the said John Alexander her husband whether she doth the same freely and voluntarily, without his persuasions or threats, and whether she be willing that the same shall be recorded in our said county Court, and when you have received her acknowledgment and examined her as aforesaid, that you distinctly and openly certify us thereof, in our said Court, under your hands and seals, sending then there the said Indenture and this writ. Witness Chesley Kinney, Clerk of our said Court at the Courthouse, the 29th day of October 1808 and in the thirty third year of the Commonwealth. Augusta County, to Wit, By Virtue of the above Commission to us direct, we the subscribers, being Justices of the Peace for the said County, do hereby certify that we did personally go to the above named Martha and examined her privily and apart from the above named John Alexander her husband, and we do further certify that she freely and voluntarily acknowledged the Indenture hereunto annexed, and she did it without persuasions or threats of her said husband, and that she was willing the same should be recorded in the County Court of Augusta. Given under our hands & seals the 29th day of October 1808 and in the 33d year of the Commonwealth. Jno. Wayt (Seal) William Boys At a Court continued & held for Augusta County March the 29th 1809 This Indenture of bargain & sale between John Alexander and Martha his wife of the one part, and Gabriel Alexander of the other part was proven by the oaths of John Cochran, Taylor Williams and William Clarke three of the witnesses thereto and ordered to be recorded together with a commission for the privy examination of the said Martha & a certificate of its execution thereof.
