All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.rootsweb.com/~archreg/vols/00012.html#0002870 August 15, 2007, 12:12 am Written: May 13, 1797 Recorded: December 24, 1800 Augusta County, Virginia Deed Book 31, pages 196-198 This Indenture made this thirteenth day of May in the year of our Lord one thousand seven hundred and ninety seven between Andrew Lackey and Margaret his wife of the County of Augusta & State of Virginia of the one part and George Leonard of the County and State aforesaid of the other part Witnesseth that the said Andrew Lackey and Margaret his wife in consideration of the sum of three hundred pounds Lawful money of Virginia to them in hand paid by the said George Leonard (the receipt whereof is hereby acknowledged) have granted bargained and sold and by these presents do grant bargain and sell unto the said George Leonard his heirs & assigns two certain Tracts or parcels of Land lying and being in the County of Augusta on both sides of the Elk Run. The first Survey containing by estimation one hundred and eight acres (be the same more or less) and bounded as follow**** Begining at a white oak corner to Nicholas Bush and with his line North West one hundred and forty poles crossing the run to a white oak, thence South West one hundred & twenty poles to two Black oak Saplins Corner to Thomas Hutchison deceased and with his line South East one hundred and forty poles crossing the run to a white oak Corner to said Hutchison and North East one hundred and twenty poles to the Begining. The other Survey containing thirty five acres Joining to old survey and Bounded as followeth, to wit. Begining at a white oak Corner to the old Survey & corner to Nicholas Bush and with said Bush's line North East eighty poles to a pine on said line and South fifty Five East seventy poles to three White Oaks on a hill side South forty seven West Eighty poles to a pine and North sixty three West forty six poles to a pine North thirty four West seventy [poles] to the Begining. To have and To hold the said Tracts or parcels of land with all and singular the appurtenances thereunto belonging to the said George Leonard and his heirs and assigns forever and the said Andrew Lackey and Margaret his wife for themselves their heirs executors and administrators doth covenant with the said George Leonard his heirs and assigns that they the said Andrew Lackey and Margaret his wife their heirs executors and administrators the said Tract of Land with all its appurtenances to the only proper use and behoof of him the said George Leonard and his heirs and assigns against the lawful claim or claims of them the said Andrew Lackey & Margaret his wife and of all and every other person or persons whatsoever will forever warrant and defend by these presents. In Witness whereof the said Andrew Lackey and Margaret his wife have hereunto set their hands and seals the day and year first above written. McClanachan At a Court held for Augusta County the sixteenth day of April 1799 This Indenture of Bargain & Sale between Andrew Lackey & Margaret his wife of the one part and George Leonard of the other part was proved by the oath of Robert McClanachan a witness thereto. At a Court held for Augusta County the 24th day of December 1800 This Indenture of Bargain & Sale between Andrew Lackey & Margaret his wife of the one part and George Leonard of the other part having been heretofore proved by the Oath of Robert McClanachan, was this day further proved by the Oaths of Thomas Bowyer and John Dickenson, the other Witnesses thereto and ordered to be recorded, together with the commission & certificate of the privy examination of the said Margaret which is returned executed. Teste Chesley Kinney Clk The Commonwealth of Virginia to Alexander Humphrey & Robert Grattan gentlemen Justices of Augusta county, Greeting. Whereas Andrew Lackey and Margaret his wife, by their certain Indenture of bargain and Sale bearing date the 13th day of May 1797 have sold and conveyed unto George Leonard one hundred and forty three acres of Land with the appurtenances lying and being in the County of Augusta and whereas the said Margaret cannot conveniently travel to our County Court of Augusta to make acknowledgement of the said conveyance. Wherefore we do give unto you power to receive the acknowledgement which the said Margaret shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is hereunto annexed. And we do therefore command you that you do personally go to the said Margaret and receive her acknowledgment of the same **** examine her privily and apart from the said Andrew Lackey her husband **** showeth the same freely and voluntarily without his persuasion or **** and whether she be willing that the same shall be recorded in our County **** Augusta aforesaid And when you have received her acknowledgment and examined her as aforesaid that you distinctly plainly and openly certify us thereof at our said County Court under your hands and seals sending then there [?] the said Indenture. Witness Jacob Kinney; Clerk of our said Court at the Court house this 13th day of May 1797 in the 21st year of the Commonwealth. Augusta County Court By virtue of the above Commission to us **** we do hereby certify that we did personally go to the above named Margaret Lackey and examined her privily and apart from the above named Andrew Lackey her husband and we further certify that she Declared that freely and voluntarily acknowledged the Indenture hereunto annexed and that She did it without the persuasion or threats of her said Husband and that she was willing the same shall be recorded in the county court of Augusta.
