Deeds of Lease & Release, 400 acres- indenture of lease dated 26 Feb 1749, proved 27 Feb 1749; indenture of release dated 27 Feb 1749, proved 27 Feb 1749 This Indenture made this twenty six day of February in the Year of our Lord One thousand Seven hundred and forty nine between William Beverly Esqr of the County of Essex of one part, and William Long of the County of Augusta of the other part. Witnesseth that the said William Beverly for and in Consideration of the price of five Shillings Current Money of Virginia to him in hand paid by the said Wm Long at or before the Sealing and delivery of these presents to the receipt whereof is hereby acknowledged Hath granted bargained and sold and by these presents doth grant bargain and Sell unto the said William Long one piece or parcel of Land containing four hundred Acres be the same more of less lying and being in Beverly Mannor in the said County of Augusta, and bounded as followeth, viz Beginning at two white oaks in the patent line of said Mannor, corner to John Wilsons Land and runneth with his lands North three Degrees West three hundred and sixty poles Crossing the South River of Shanendo to two Chestnuts trees on the North side of a hill, Corner to Col James Pattons, John Wilsons and William Robinsons Lands, thence with said Col Pattons line of his Mill place North Eighty six degrees East one hundred and fifty six poles to a hicory Corner of James Bells Land thence with said Bells Line South five degrees East four hundred and forty six poles Crossing said River at a black oak a pine and a white oak sapling in the Mannor line, Corner to said Bells Land, thence with the patent line North fifty Degrees West one hundred and thirty poles to three pines, thence with the patent line South Eighty Degrees West Eighty poles to the beginning and all houses buildings Orchards Ways Waters, watercourses, profits Comodities Hereditaments and Appurtenances whatsoever to you(?) premises hereby granted or any part p.480 thereof belonging or in any wise Appurtaining, And the Reversion and Reversions Remainder and Remainders Rights ??? and profits thereof, To have and to hold the said four hundred Acres of Land be the same more of less and all and singular other the promises hereby granted with the Appurtenances unto the said William Long his Executors Administrators and Assigns from the day before ??? hereof for and during the full term and time of one whole Year from thence ???ing fully to be compleat and ended Yielding and paying therefore rent of one pepper Corn on Lady day and if the same shall be lawfully demanded to?? intent and purpose that by virtue of these presents and of the Statute for transferring ??? possession the said William Long may be in Actual possession of the premises and be thereby enabled to accept and take a grant and Release of the Reversion and ?????ned thereof to him and his heirs. Right Title ???? ??? property Claim and Demand whatsoever of him the said William Beverley aforesaid to the said premises and all Deeds Evidence and writings touching or in any wise concerning the land, To have and to hold, the said four hundred acres of Land be the same more of less and all and singular other the premises hereby granted and released and every part and parcel thereof with the ???d every of their Appurtenances Unto the said William Long his heirs and assigns forever to the only proper ????? behoof of him the said William Long and of his heirs and Assigns forever. And the said William Beverley for himself his heirs Exrs and Administrators doth Covenant promise and grant to and with the said Wm Long his heirs and assigns by these presents that the said William Beverley sold at the Time of sealing and Delivering of these presents is seized of????? And ???? perfect and ???ble Estate of In??? in his ??? of and in the premises hereby granted and ????? And that he has good power and Lawfull and absolute authority to grant and Convey t/? and ??? said William Long in Manner and form aforesaid and that the said premises n??? and to forever hereafter Shall remain and be free and Clear of and from all former and other Gifts Grants bargains sales Dower Rights and title of Dower, Judgments Executions Titles Tr????? Charges and ??? ???? whatsoever make ??? comitted ????ed by p.482 the said William Beverley or any other person or persons whatsoever. This Quick rent to hereafter ??? due and payable loans Sovereign Lord the King his heirs and Executors for and in ?????? of the said premises only excepted And for ???rized. William BEVERLY was granted several patents 30 August 1743, including one in Augusta Co.- 700 acres on the head of the Great Calf Pasture River, adjoining John Preston. source: Virginia Land Office Patents No. 21, 1742-1743, p. 443. Col. William BEVERLEY was granted three patents in Augusta Co. 1 October 1747- 141 acres on a branch of the Little River of the Calf Pasture River called Halls Creek; 400 acres on a branch of the Little River of the Calf Pasture River called Smiths Creek; and 361 acres on a branch of the Little River of Calf Pasture called Halls Branch. source: Virginia Land Office Patents No. 26, 1747-1748, pp. 102-06. The 400-acre tract is the most similar- Beginning at a Hickory & White Oak at the foot of Brown Hill, in a line of William McCUTCHING's Land, thence S 7° E 120 poles crossing the creek to 3 White Oaks, thence N 66° E crossing several Branches 278 poles to 3 White Oaks, thence N 60° E crossing a Branch 82 poles to a Pine, thence N 52° E 190 poles to 3 White Oaks, thence N 40° W 136 poles crossing 2 Branches to 3 Pines, thence S 53° W 276 poles to 2 Hickorys & a White Oak, thence S 63° W 200 poles to the Beginning.
