Deed of Lease, 433 acres- indenture of lease dated 26 Feb 1749, proved [27] Feb 1749; indenture of release dated [27 Feb 1749], proved 27 Feb 1749 This Indenture made this twenty sixth day of February in the Year of our Lord One thousand Seven hundred and forty Nine Between William Beverley Esqr of the County of Essex of the one part And William Long of the County of Augusta of the other part. Witnesseth that the said William Beverley for and in Consideration of the sum of five Shillings current Money of Virginia to him in hand payd by the sd William Long at or before the Sealing and Delivery of those presents the Receipt whereof is hereby acknowledged, Hath granted bargained and sold and by these presents Doth grant bargain and sell unto the said William Long One piece or parcel of Land containing four hundred and thirty three Acres and a half lying and being in Beverley Mannor in the County of Augusta and bounded as followeth: viz Beginning at a pine in the Mannor Line Corner to Gabriel Alexander Land and runneth thence with his line North five Degrees West five hundred & fifty seven poles to a large white oak Corner to said Alexander, thence South Eighty five Degrees East one hundred and twenty five poles to two black oaks and a white oak p.483 Corner of John Blacks Land thence with his Line South five Degrees East to two pines on a hill on the South side of South River in a Line of the Mannor thence with the Mannor line to the Beginning, and all houses, buildings, Orchards, Ways Waters, Water courses, profits, commodities, Hereditaments and appurtenances whatsoever to?? premises hereby granted or any part thereof belonging or in any wise appertaining and the Reversion and Reversions, Remainder and Remainders, Rents, ??? and profits thereof. To have and to hold, the said four hundred and thirty three acres and a half be the same more or less, all and singular other the premises hereby granted with the appurtenances unto the said William Long his Executors Admr’s & Assigns from the day before the date, hereof for and during the full term and time of one whole Year, from ??? ??? ???ing fully to be compleat and ???ed yielding and paying therefore the rent of one pepper Corn on Lady day next, if the ??? shall be lawfully demanded, pay interest and ?????? that by Virtue of these presents and of the Statutes for transferring ?????? possesion the said William Long may be in Actual possession of the premises and be thereby enabled to Accept and take a grant and Release of the Reversion and Inheritance thereof to him and his heirs. In Witness whereof the said William Beverley hath thereunto set his hand & seal the day & year first above written. Test John Madison Cl Court ****************************************************************************** This Indenture [unreadable bad ink smudge] Between William Beverley Esqr of the County of Essex of the one part and William Long of the County of Augusta of the other part. Witnesseth that for and in Consideration of the sum of thirteen pounds Current Money of Virginia to the said William Beverley in hand paid by the said William Long at or before the Sealing and delivery of these presents the receipt is whereof he doth hereby acknowledge and thereof doth release acquit and discharge the said William Long his Executors and Admrs by these presents He the said William Beverley Hath granted bargained Sold, Aliened Released and Confirmed and by these presents doth grant bargain Sell alien Release and confirm unto the said William Long in his Actual possession now being by p.484 the Virtue of a bargain and Sale to him thereof made, by the said William Beverley for one whole Year, by Indentures bearing date the day next before the day of the Date, of these presents and by force of the Statute of transferring ??? into possession and his heirs forever one piece or parcel of Land containing four hundred and thirty three acres and a half lying and being in Beverley Mannor in the County of Augusta and bounded as followeth: viz Beginning at a pine in the Mannor Line, corner to Gabriel Alexanders Land and runeth thence with his line North five degrees West five hundred and fifty seven poles to a large white oak Corner to said Alexander, thence South eighty five degrees East One hundred and twenty five poles to two black oaks and a white oak, Corner to John Blacks Land, thence with his Line South five Degrees East to two pines on a hill, on the South Side of the South river in a Line of the Mannor, thence with the Mannor Line to the Beginning, And all houses buildings Orchards Ways, Waters, Watercources profits Comodities Hereditaments and Appurtanances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise Appurtaining. And the Reversion and Reversions, Remainder and Remainders, Rents, ??? and profits thereof; And also all the Estate Right, Title, Interest, ??? ??? property Claim and Demand whatsoever of him the said William Beverley of in and to the said premises and all Deeds Evidences and Writings touching or in any wise concerning the same. To have and to hold, the said four hundred and thirty three acres and a half of [ink smudge] same more or less and all and singular other the [ink smudge] hereby granted and Released and [ink smudge] part and [ink smudge] of [ink smudge] And the said William Beverely [ink smudge] heirs Executors and Administrators doth covenant promise and grant to & with the said William Long his heirs and Assigns by these presents that the said William Beverley now at the time of Sealing and delivering of these presents is seized of a good ??? perfect and Ind???ble Estate of Inheritance in fee simple of and in the premises hereby granted and Released. And that he hath good power and Lawful and absolute authority to grant and convey the Same to the said William Long in manner and form aforesaid. And that the said premisses ???ed and To forever hereafter Shall remain and be free and clear of and p.485 from all former and other Gifts Grants Bargains Sales Dower Right & title of Dower Judgments Executions Titles profits Charges and Incumberances whatsoever, made done committed Suffered by the said William Beverley or any other person or persons whatsoever, to the Quit rents hereafter ??? due and payable to our Sovereign Lord the King his heirs and Successors for and in reproach of the said premises only excepted and for???rized. And Lastly that the said William Beverley and his heirs all and singular the premises hereby granted and released with their appurtenances unto the said William Long his heirs and assigns against him the said William Beverley and his heirs and all and every other person and persons whatsoever, Shall and will warrant forever Defend by these presents.
