All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Augusta County Virginia USGenWeb Archives Deeds Samuel CLARK [CLARKE] & James CRAWFORD, of Staunton, to George Scott KENNEDY, of Augusta Co., Deed of Bargain & Sale, dated 15 Feb 1823, proved 17 Feb 1823 ~ 180 acres, devised by heirs of William & Alexander LONG, dec'd This Indenture made the 15th day of February in the year of our lord one thousand eight hundred and twenty three between Samuel Clark & James Crawford of the town of Staunton & state of Virginia of the one part, and George Bell Kennedy of the County of Augusta & state aforesaid of the other part, witnesseth, that whereas William Long late of the County of Augusta dec’d did by his last will and testament devise to his son, Alexander Long, the one half of a mill then situated on the south river in the county aforesaid, and ten acres of land adjoining thereto. And to his son, James, one half of the land not previously disposed of being part of the land on which he then resided lying along James Bell’s line and the other half of the mill aforesaid, as will appear reference being paid to the said will bearing date 29th day Jan 1781, and of record in the County Court office of Augusta. And whereas the said James Long did afterward convey the said land and moiety of the mill aforesaid to the said Alexander Long as will appear by his deed therefor bearing date 16th day of June 1788, also of record in the office aforesaid; And also whereas the said Alexander Long late of the county aforesaid hath departed this life intestate leaving considerable estate of which the land devised and conveyed to him as aforesaid forms a part, and leaving the following persons, to wit, Samuel Long, Joseph Long, David Long, Francis Long, James Long, and Dorcas Barnett the wife of Alexander Barnett, his brothers & sisters, and the children of Elisabeth Henderson late Elisabeth Long, to wit Nancy Mitchell, the wife of George Mitchell, Samuel Henderson, and William L. Hendeson his only legal heirs and representatives, and whereas the said James Long hath departed this life having first made & published his last will and testament whereby he devised his interest in the real estate aforesaid to the daughters of the said David Long as will appear by his will bearing date 12th day February 1810 and of record in the office aforesaid; And also whereas the said Samuel Long hath departed this life intestate as to his share of the real estate aforesaid whereby his surviving brothers & sisters & the aforesaid children of Elizabeth Henderson became entitled thereto; And whereas the aforesaid & representatives of the said Alexander Long for the purpose of more conveniently effecting a sale of the said real estate, have conveyed their rights therein to the said Samuel Clark & James Crawford in trust for that purpose. The said David Long & others by deed bearing date 20th day Dec 1817, Alexander Barnett & wife by deed bearing date the 13th day of April 1818, William L. Henderson by deed dated 15th day of June 1818, James Long & wife by deed dated 13th day of February 1819, and George Mitchell & wife, & Samuel Henderson & wife by deed dated the 3rd day of April 1819 as well .......... p.2 to the said several deeds, all of which are entered to the record in the County Court office aforesaid. Now therefore this Indenture witnesseth that the said Samuel Clark & James Crawford for and in consideration of the sum of Two thousand five hundred and seventy four dollars lawfull money of the state aforesaid to them in hand paid or secured to be paid by the said George Scott Kenneday, the receipt whereof is hereby acknowledged, have granted, bargained, and sold, and by these presents, and in pursuance of the authority vested in them by the deeds aforesaid, do grant bargain and sell unto the said George Scott Kenneday his heirs and assigns a certain tract or parcel & lying and being in the said County of Augusta on both both sides of the South river containing by estimation one hundred & eighty poles, be the same more or less being the same land which was devised & conveyed to the said Alexander Long aforesaid and bounded as followeth, to wit beginning at a pine white oak and black oak corner to Joseph Bell, and with his line North nine & three eights degrees West, four hundred & sixty poles, crossing the river to a large hickory corner to the said Bell & boundary, thence with boundary line South Seventy eight degrees West, Seventy poles to between a blazed hickory, dead locuts & Spanish oak in said line, thence south nine & one eight degrees East Two hundred & forty eight poles to the river, and the same course continued one hundred & fifty poles further making together Three hundred & ninety eight poles, to a small blazed pine, black oak & red oak in the line of a tract of land patented to the said Alexander Long, and with the same South fifty four degrees East, one hundred pole to the beginning, together with all and singular the appurtenances, thereunto belonging in any wise appertaining; To have and to hold the said tract or parcel of land with its appurtenances unto the said George Scott Kenneday his heirs & assigns, to the only proper use and behoof of him the said George Scott Kenneday his heirs & assigns forever; And the said Samuel Clark and James Crawford for themselves their heirs Ex’rs & Adm’s do covenant with the said George Scott Kenneday his heirs & assings, that they the said Samuel Clarke & James Crawford, their heirs, Ex’rs & Ad’rs the said tract or parcel of land with its appurtenances unto the said George Scott Kenneday his heirs and assigns against the claim or claims of them the said Samuel Clark and James Crawford & their heirs, and of all and every person or persons claiming under them and them only, shall & will warrant and forever defend by these presents. It being distinctly understood that the said Samuel Clarke & James Crawford are not to be in any manner responsible for the title to the said land, nor are the aforesaid representatives of Alexander Long to be in any way responsible nor any of the purchase money withheld on account of any claim which the said George Scott Kenneday may set up under the will of William Long dec’d for the right to conduct the water along the old race to the site the mill formerly stood, this sale and conveyance being made with a view to place the said Kenneday on the same ground as to every right which Alexander Long had, but without any responsibilities to the race aforesaid.
