Samuel & William LONG, quit claim, dated 3 Sep 1823, proved 22 Apr 1824, rec'd 26 Aug 1824 This Indenture made the 3rd day of September in the year of our Lord one thousand eight hundred & twenty three between Jane Long, Elizabeth Long, Rebecca Long, Dorcus Long, & Alexandria H. Long of the County of Augusta of the one part, & Samuel & William Long of the County aforesaid of the other part. Whereas Samuel Long by his Last Will & Testament dated the fifth day of December 1805, among others made the following bequests. Item I give & bequeath to my brother David’s Son Samuel my land on the South River which I live on & half on the Negores this is not willed & the half of the Negroes that is not willed and the half of the Cattle & all the money excepting which shall be hereafter mentioned to him his heirs & assigns forever. Item I give & bequeath to Wm Long David’s son the other half of the Negroes & monies & cattle to him his heirs & assigns forever. Item It is my will & do order that in case any of the above mentioned Samuel & William Long do without Legal issue the part willed to them goes unto the other, & if they both do without Legal issue then it is to be divided amongst David’s heirs. And whereas the said Jane Long, Rebecca Long, Dorcus Long, Elizabeth Long & Alexandrus H. Long who with the said William Long & Samuel Long are the children of the said David Long & am desirous of releasing to the said William and Samuel Long all the contingent estate or in trust which they now have or might hereafter have in the property mentioned in the above recited clauses of the will of Samuel Long dec’d so as to vest in the said William & Samuel Long an absolute unconditional & ultimate estate in fee simple. Now this Indenture whereforth that the said Jane Long, Elizabeth Long, Rebecca Long, Dorcus Long & Alexandrus H. Long for & in consideration of the p. 554 premised and of the further consideration of one dollar to them in hand paid by the said William & Samuel Long the receipt whereof is hereby acknowledged have granted bargained and sold, released & quit claim & by these presents do grant, bargain, sell, release, & quit claim unto the said Samuel & William Long, any right title or interest which they now have or may thereafter share to the property mentioned in the above recited clauses of the will of the said Samuel Long dec’d together with all the appurtenances thereunto belonging, or in any wise appertaining. To have & to hold the said property with it appurtenances, unto the said Samuel Long & William Long & their heirs or assigns forever and the said Jane, Elizabeth, Rebecca, Dorcus & Alexandrus H. Long for themselves, their heirs executors & administrators do covenant with the said Samuel & William Long, their heirs & assigns that they the said Jane, Elizabeth, Rebecca, Dorcas & Alexandrus H. Long their heirs executors & administrators the said property with its appurtenances unto the said Samuel Long & William Long, their heirs & assigns against the claim or claims of the said Jane, Elizabeth, Rebecca, Dorcus & Alexandrus H. Long, & all persons claiming by through or under them shall & will warrant & forever defend by these presents. In Witness whereof the said Jane Long, Elizabeth Long, Rebecca Long, Dorcus Long & Alexandrus Long have hereunto set their hands & seals the day Viz first above written. Long {Seal} Augusta County to wit: We Joseph Bell & Wm Davis justices of the peace in the county aforesd in the State of Virginia do hereby certify that Jane Long, Elizabeth Long, Dorcas Long, Rebecca Long & Alexandrus H. Long parties to a certain deed bearing date on the 5th day of September p. 555 in the year 1823 & hereto annexed personally appeared before us in our County aforesaid & acknowledged the same to be their act & deed & desired us to certify the said acknowledgement to the clerk of the County Court of Augusta in order that the said deed may be recorded. Given under our hands & seal this 22nd day of April 1824.
