All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Augusta County Virginia USGenWeb Archives Deeds William LONG & wife Mary to Joseph CLINE, Deed of Bargain & Sale- 96 2/3 acres, dated 25 Nov 1806 (not recorded) Heirs of Joseph CLINE vs. William LONG, Chancery suit, heard 31 May 1834 This Indenture, made the 25th day of Nov’r in the year of our Lord one thousand eight hundred and Six, Between William Long & Mary his wife of the County of Augusta & State of Virginia of the one part, and Joseph Cline of the County & State afores’d of the other part. Witnesseth, that the said William Long & Mary his wife for and in consideration of the sum of one thousand Dollars lawful money of Virginia to them in hand paid by the said Joseph Cline the receipt whereof is hereby acknowledged, hath granted, bargained, & sold, and by these presents do grant, bargain, sell unto the said Joseph Cline & his heirs & assigns forever, a certain tract or parcel of land lying & being in the County aforesaid, containing by estimation ninety six & two thirds Acres, be the same more or less lying on the South Branch of naked Creek & adjoining the lands of Jacob Sheets, William Blair, & Abeigh Donaghe, being two undivided moieties of a certain tract of land, one moiety of which was devised to p. 128 the said Mary Long by the Will of John Blair bearing date the 15th day of April 1788, and the other moiety was conveyed to the aforesaid William Long by Deed from Jane Blair bearing date the 27th day July 1801 which will appear by reference being had to the Record of Augusta Court. Also said land of ninety six Acres & two thirds of an acre is Bounded by the following line, to wit, Beginning at a black oak Sapling corner to Joseph Conyer’s Patent South 65 ½ W 140 poles to 2 pines the patent corner, thence South twenty Six & one half acres East 152 poles to a white oak by some rocks, thence N 65 ½ East 106 poles to a red oak in the line of said patent, thence crossing the tract North 54 West 74 poles to a stake by a rock, North 31 ½ West 32 ½ poles to a Walnut, thence North 18 East 59 poles to the Beginning together with all & singular the appurtenances thereunto belonging or in any wise appertaining, To have & to hold the said tract or parcel of land with its appurtenances, unto the said Joseph Cline & his heirs & assigns forever, to the only proper use & behoof of him the said Joseph Cline & his heirs & assigns forever. And the said William Long & Mary his wife for themselves their heirs Ex’rs & Admint’rs, do covenant with the said Joseph Cline his heirs & assigns, that they the said William Long & Mary his wife their heirs Extr’s & Admintrs the said tract of land with its appurtenances unto the said Joseph Cline his heirs & assigns, against the claim or claims of them the said William Long & wife, their heirs etc of all & person or persons whatsoever shall & will warrant and forever defend by these presents. In Witness whereof the said William Long & Mary his wife have hereunto set their hands & seals on the day & year first above written. Signed Sealed & delivered William Long {Seal} in the presence of Mary Long {Seal} William Herman John Early Peter Hanger The Commonwealth of Virginia, to Alex’r St.Clair & David Parry Gentleman Justices of Augusta County, Greeting. Whereas William Long & Mary his wife by their certain Indenture of Bargain & Sale bearing date the 25th day of Nov’r 1806 have sold & conveyed unto Joseph Cline a certain tract of land with its appurtenances lying & being in the County of Augusta. And whereas the said Mary Long cannot conveniently travel to our District Court of Staunton, to make acknowledgement of the said conveyance, therefore we do give unto you, or any two or more of you, power to receive the acknowledgement which the said Mary shall be willing to make before you of the conveyance contained in the said Indenture, which is hereunto annexed; and we do therefore command you that you do personally go to the said Mary Long & receive her acknowledgment of the same; and examine her privately and apart from the said William Long, her husband whether she doth the same freely & voluntarily with his pursuations or them; And whether she be willing that the same shall be recorded in p. 129 our District Court. And when you have received her acknowledgment & examined her as aforesaid, that you distinctly & openly certify us thereof, in our said Court under your hands & seals sending them there the said Indenture & this Writ. Witness, Micajah Coalter Clerk of our said Court at the Court house, the 25th day of Novr 1806, and in the 31st year of the Commonwealth. Micajah Coalter Augusta County, to Wit: By virtue of the above Commission to us directed, we the subscribers being justices of the Peace for the said County, do hereby certify that we did personally go to the above named Mary Long & examined her privily & apart from the above named William Long her husband, and we do further certify that she freely & voluntarily, acknowledged the Indenture hereunto annexed, and that she did it without persuasions or threats of her said husband & that she was willing that the same should be recorded in the District Court of Stanton. Given under our hands & seals the third day January 1807 & in the 31st year of the Commonwealth. Alex’r St.Clair {Seal} David Parry {Seal} At a Court held for Augusta County on Saturday May the 31st 1834 Sally Cline, Widow & relict of Joseph Cline dec’d, George} Cline, John Cline, Joseph Cline, Frederick Cline, David }Plaintiffs } Cline, Samuel Cline, Christopher Cline, Joseph Burkett & } } Catherine his wife late Catherine Cline & John Wampler & } } Mary his wife late Mary Cline. } }In Against }Chancery William Long }Deft } This Cause came on to be heard this 31st day of May 1834 on the Bill & exhibits & was agreed by Counsel, And it appearing to the satisfaction of the Court that the Plaintiffs have proceeded according to Law and the rules of this Court against the Defendant who resides without this Commonwealth, and the said Defendant having failed to make his appearance & answer the Plaintiffs Bill, the same is taken for confessed. It is therefore adjudged, ordered & decreed, that the Deed executed by the Defendant and his wife (to Joseph Cline, the ancestor of the Pltffs) bearing date the 28th day of Novr 1806 & filed to record in the Clerks Office of the County Court of Augusta, the said Deed appearing to have been duly & properly executed on the part of the grantors but omitted to be recorded in consequence of the neglect of the grantee. And it is further adjudged, ordered & decreed that the Pltffs pay the Costs of this Suit.
