All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Augusta County Virginia USGenWeb Archives Deeds Samuel CLARKE & James CRAWFORD, trustees for the heirs of Alexander LONG (& sons Francis & Samuel), to David BRAND, Deed of Bargain & Sale- 210 acres, dated 1 Aug 1834, acknowledged 2 Aug 1834 This Indenture, made the 1st day of August, in the year of our Lord one thousand eight hundred & thirty four Between Samuel Clarke & James Crawford of the County of Augusta & State of Virginia, of the one part & David Brand of the County & State aforesaid of the other part. Witnesseth, that whereas Alexander Long late of the said County departed this life intestate leaving considerable real estate of which the land hereinafter described [is] p.143 a part, & leaving the following persons to Wit. Samuel Long, Joseph Long, David Long, Francis Long, James Long & Dorcas Barnett the wife of Alexander Barnett, his brothers & sisters & the children of Elizabeth Henderson, late Elizabeth Long, to Wit. Nancy Mitchell the wife of Sam’l G. Mitchell, Saml Henderson, Jr, William L. Henderson, his only legal heirs & representatives; And whereas the said Francis Long hath departed this life having first made & published his last Will and Testament, whereby he devised his Interest in the real estate of the said Alexander Long to the daughters of the said David Long, as will appear by his Will bearing the date the 12th day of February 1810, and of record in the County Court Office of Augusta; And also whereas the said Samuel Long hath departed this life intestate to his share of the real estate aforesaid, whereby his surviving brothers & sisters & the aforesaid children of Elizabeth Henderson became entitled thereto, And also whereas the aforesaid heirs & representatives of Alex’r & of Francis & Samuel Long for the purpose of more conveniently effecting a Sale of the real estate of the said Alexander Long have conveyed their rights therein to the said Samuel Clarke & James Crawford in trust for the purpose the said David Long & others by Deed bearing date the 26th day of Dec 1817. Alexander Barnett & wife by Deed bearing date the 13th day of April 1818. William L. Henderson by Deed bearing date the 15th day of June 1818. Jas Long & wife by Deed bearing date the 13th day of February 1818 & Saml G. Mitchell & wife & Saml Henderson by Deed bearing date the 3rd day of April 1819. As well appear reference being had to the said Deeds, all of which are of record in the Office aforesaid, as now this Indenture. Witnesseth, that the said Samuel Clarke & James Crawford, for & in consideration of the sum of Three hundred dollars current money, to them in hand paid by the said David Brand the receipt whereof is hereby acknowledged, have granted, bargained, & sold & by these presents and by virtue of the Deeds of Trust aforesaid, do grant, bargain & sell unto the said David Brand his heirs & assigns a certain tract or parcel of land, lying & being in the County of Augusta, on the South East side of the South River, containing by survey recently made, Two hundred & ten Acres being a part of a tract of four hundred Acres granted to the said Alexander Long by patent bearing date the 3rd day of August 1771, and bounded as follows, to Wit. Beginning at a stake between a black oak & pine pointers, thence with Beverly Manor S 85 ¼ W 215 ¾ poles to a stake, corner to William Johnston South 179 poles to a stake one pole from a black oak pointer, N 85 ¼ E 164 poles crossing the old pine road to a pine & N 16 E 170 poles to the Beginning, together with all & singular the appurtenances thereunto belonging or in any wise appertaining; to have & to hold the said tract or parcel of land with its appurtenances, unto the p.144 said David Brand, his heirs or assigns, to the only proper use & behoof of him the said David Brand his heirs & assigns forever. And the said Samuel Clarke & James Crawford for themselves their heirs, Excr, & Adminrs do covenant with the said David Brand his heirs, Excrs, & assigns that they the said Samuel Clarke & James Crawford their heirs Extrs & Admintrs the said tract of land with its appurtenances unto the said David Brand his heirs Excrs assings against the claim or claims of them the said Samuel Clarke & James Crawford & their heirs & of all & every person or persons whatsoever claiming under them & them only, shall & will warrant & forever defend by these presents. In Testamony whereof the said Samuel Clarke & James Crawford have hereunto set their hands & seals the day & year fist above written.
