Deed: Adam Stephen to Henry Miller and Mark Bird, 1774 Source: Augusta Co., VA Deed Book 20, page 352 Contributor: Diana Lehman --------------------------------------------------------- This Indenture made this seventh day of April in the year of our lord one thousand seven hundred & seventy four Between Adam Stephen of the County of Berkley in the Colony of Virginia of the one part and Mark Bird & Henry Miller of the County of Berks in the province of Pensylvania of the other part Witnesseth that thesaid Adam Stephen for and in Consideration of the sum of one Hundred & ten pounds Pennsylvania money to him in hand paid by thesaid Mark Bird and Henry Miller at or before the sealing and delivery of these presents the receipt whereof is hereby Acknowledged Hath granted bargained sold aliened released & Confirmed and by these presents Doth grant bargain sell alien release and Confirm unto thesaid Mark Bird and Henry Miller (in their actual possession now being by virtue of a bargain and sale to them thereof made by thesaid Adam Stephen for one whole year by Indenture bearing date the day next before the day of the date of these presents and by force of the statute for Transferring uses into possession) and their Heirs all that tract of land situate lying and being upon Mossey Creek in the County of Augusta and Bounded as followeth Viz Beginning at two Hiccorys and a spanish oak on the north side of the Creek and running thence north twenty degrees east three Hundred and twenty five poles to three pines in a Valley thence south fifty two degrees east and one Hundred & eighty poles Crossing the Creek to two pines on a Hill thence south thirty six degrees west one Hundred & twenty poles to a pine in a line of Edward Erwene thence with his his line south sixty six degrees west one hundred & ten poles crossing the Creek to two pines Corner to thesaid Erwine thence south Twenty five degrees west seventy two poles crossing the Creek to a pine on the top of a hill thence north seventy two degrees west fifty six poles crossing the Creek to the Beginning Containing two Hundred and twelve acres It being the tract land which thesaid Adam Stephen purchased of William Minter & all houses buildings gardens orchards yards Meadows Trees woods underwoods ways paths water Water-Courses proffits Commodities Hereditaments and appurtenances whatsoever to thesaid Premises hereby granted belong or in any wise appertaining and the reversion & reversions remainder & remainders rents Issues and profits thereof and of every part & parcel thereof and also all the estate right title use trust Interest property Claim and demand of him thesaid Adam Stephen of in and to thesaid Premises To have and To hold thesaid tract of land Hereditaments and all and Singular the premises beforementioned with their & every of their appurtenances unto them thesaid Mark Bird and Henry Miller and their Heirs to the only proper use and Behoof of them thesaid Mark Bird and Henry Miller their heirs and assigns forever & thesd. Adam Stephen for himself his heirs Executors and administrators doth Covenant and grant to and with thesaid Mark Bird & Henry Miller and their heirs and assigns that thesaid Adam Stephen now is the true right full and lawful owner of thesaid tract of land hereditaments & all & Singular the premises before mentioned with their and every of their appurtenances & also that thesaid Adam Stephen hath good rightfull power & lawfull authority to grant bargain sell & Convey thesaid tract of land Hereditaments and premises beforementioned with their & every of their appurtenances to the only proper use and behoof of them thesaid Mark Bird and Henry Miller their Heirs & assigns forever and also that thesaid Adam Stephen now is seized in his own right of a good sure perfect absolute and indeasible estate of Inheritance in fee simple of in and to thesaid tract of land hereditaments & all & singular the premises beforementioned with their & every of their appurtenances without any manner of Condition Mortgage Limitation of use or uses or other Matter cause or thing to alter Change Charge or determine the same & also that they thesaid Mark Bird and Henry Miller shall and May from time to time and at all times forever hereafter peaceably and quietly enter into have hold occupy possess and enjoy thesd.
