Deed: Edward Erwin to Henry Miller and Mark Bird, 1777 Source: Augusta Co., VA Deed Book 22, page 244 Contributor: Diana Lehman -------------------------------------------------------- Examind & Delivered March 1779 This Indenture made the fifteenth day of December in the year of our Lord one thousand seven hundred & Seventy seven between Edward Erwin and Mary his Wife of the parish & County of Augusta in the state of Virginia of the one part & Mark Bird of the state of Pensylvania and Henry Miller of thesaid Parish & County of Augusta Partners and Ironmen of the other part Witnesseth that for and in Consideration of the sum of Twenty Eight pounds fifteen Shillings Current money of Virginia to thesaid Edward Erwin & Mary his Wife in hand paid by thesaid Mark Bird & Henry Miller at or before the Sealing & delivery of these presents the receipt whereof they do hereby Acknowledge & thereof doth release Acquit and discharge the said Mark Bird & Henry Miller their Executors and Administrators by these Presents they thesd. Edward Erwin and Mary his Wife have and each of them Hath granted bargained sold aliened and Confirmed and by these presents do grant bargain sell alien ______ and Confirm unto thesaid Mark Bird and Henry Miller and their heirs a Certain piece parcel or tract of land Containing one hundred and thirty four Acres situate lying and being on Mossey Creek in thesaid Parish & County of Augusta and State of Virginia being the same tract of Land that was granted by Patent under the seal of the Colony of Virginia the Twelfth day of May one thousand seven hundred & Seventy to thesd. Edward Erwin by the name of Edward Erwin Junr. and bounded as followeth Beginning at two pines on the east side of the Creek and runing thence north west forty poles to a pine thence north thirty three degrees east one hundred and eighty poles to two pines thence north fifteen degrees west fifty Poles Crossing the Creek to two pines and a hiccory thence north sixty nine degrees east one hundred & twenty poles Crossing the Creek to two pines thence south forty three degrees west three hundred and twenty poles to the Beginning & all houses buildings orchards ways waters water Courses profits Commodities hereditaments and Appurtenances whatsoever to thesaid premises hereby granted or any part thereof belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents Issues & Profits thereof & also all the estate right title Interest use trust property claim and demand whatsoever of them thesaid Edward Erwin & Mary his Wife of in & to thesaid Premises & all deeds evidences and writings touching or in any Wise Concerning the same To have and to hold the lands hereby Conveyed & all & Singular other the premises hereby bargained & Sold & every part & parcel thereof with their & every of their Appurtenances unto the said Mark Bird & Henry Miller their heirs & Assigns forever to the only proper use and behoof of them the said Mark Bird and Henry Miller & of their heirs & Assigns forever and thesaid Edward Erwin and Mary his Wife for themselves their heirs Executors and Administrators do fo... promise and Consent to and with thesaid Mark Bird and Henry Miller their heirs and Assigns by these Presents that thesaid Edward Erwin and Mary his Wife now at the time of sealing and delivering of these Presents are seized of a good use & perfect and Indefeasible estate of Inheritance in fee simple of and in the premises hereby bargained & Sold & that they have good Power & Lawful and Absolute Authority to grant and Convey the same to thesaid Mark Bird and Henry Miller in a Manner & form aforesaid and that thesaid premises now are and so forever hereafter shall remain & be free & Clear of and from all former & other Gifts Grants bargains sales dower right & title of dower Judgments - Executions titles troubles Charges & Incumbrances whatsoever made done Committed or suffered by thesaid Edward Erwin and Mary his Wife or any other Person or Persons whatsoever and that thesaid Edward Erwin & Mary his Wife and their heirs all & Singular the premises hereby bargained & sold with the Appurtenances unto thesaid Mark Bird and Henry Miller their heirs & Assigns --- against them thesaid Edward Erwin & Mary his Wife and their heirs & All & every other person & persons--- whatsoever shall warrant & forever defend by these presents And Lastly that they thesaid Edward Erwin and Mary his Wife and their heirs & all & every other Person and Persons &, & their heirs any thing - having or Claiming in the premises herein beforementioned or Intended to be hereby bargained & Sold shall & will from time to time and at all times hereafter at the reasonable request and at the proper Cost & Charges in the law of them thesaid Mark Bird and Henry Miller or either of them their or either of their heirs or Assigns make do & execute or cause or forever to be made done & executed all & every such f...ther and other lawful & reasonable Act and Acts thing and things Conveyances and Assurances for the further better and more perfect Conveying and Assuring the premises aforesaid with their and every of their Appurtenances unto thesaid Mark Bird and Henry Miller their heirs & Assigns as by thesd. Mark Bird and Henry Miller or either of them or their or either of their heirs or Assigns or their Council learned in the law shall be reasonably devised advised or required In Witness whereof thesaid Edward Erwin and Mary his Wife have hereunto set their hands & Seals the day and year first above Written.
