TO ALL TO WHOM these presents shall come Greeting KNOW YE that for divers good Causes and Considerations but more Expecially for and in Consideration of the sum of TWENTY SHILLINGS of good and lawful Money for our uses paid to our Receiver General of our Revenues in this our Colony and Dominion of Virginia WE HAVE Given Granted and Confirmed and by these presents for us our Heirs and Successors do Give Grant and Confirm unto John Finley One certain Tract or parcel of Land containing One hundred and Eighty three Acres lying and being in that part of Orange County called Augusta on a branch of Cathey's River called Finley's Branch and Bounded as followeth to wit BEGINNING at two black Oaks in the William Anderson's line Hence North thirty Degrees East one hundred and thirty seven Poles between two white Oaks and a hiccory South sixty Degrees East one hundred and ninety three Poles to a pine South thirty Degrees West seventy four poles to a pine South sixty Degrees East forty seven Poles to a White Oak South thirty Degrees West sixty three Poles to a stake opposite to a blazed white Oak North sixty Degrees West Two hundred and Forty poles to the Beginning WITH ALL Woods underwoods swamps marshes Lowgrounds Meadows Feedings and his due Share of all Veins Mines and Quarries as well discovered as not discovered within the bounds aforesaid and being part of the said Quantity of One hundred and Eighty three acres of Land and the Rivers Waters and Water Courses therein contained together with the privileges of Hunting Hawking Fishing Fowling and all other profits Commodities and Hereditaments whatsoever to the same or any part thereof belonging or in anywise appertaining TO HAVE HOLD possess and Enjoy the said Tract or parcel of Land and all other the before Granted Premises and every part thereof with their and every of their appurtenances unto the said John Finley and to his Heirs and Assigns forever To the only use and Behoof of him the said John Finley his Heirs and Assigns forever TO BE HELD of us our Heirs and Successors as of our Mannor of East Greenwich in the County of Kent in Free and Common Soccage and not in Capites or by Knights Service YIELDING AND PAYING unto us our Heirs and Successors for every fifty acres of Land and so proportionably for a lesser or greater Quantity than fifty Acres the Fee Rent of one Shilling yearly to be paid upon the Feast of Saint Michael the Arch Angel and also Cullivating and Improving three acres part of every fifty of the Tract above mentioned within three years after the Date of these presents PROVIDED always that if three years of the said Fee Rent shall at any time be in arrears and unpaid or if the said John Finley his Heirs or assigns do not within the space of three years next coming after the Date of these presents Cultivate and Improve three acres part of every fifty of the Tract above mentioned Then the Estate hereby Granted shall Cease and be utterly Determined and thereafter it shall and be lawful to and for us our Heirs and Successors to Grant the same Lands and Premises with the appurtenances unto such other person or persons as we our Heirs and Successors shall think fit IN WITNESS whereof we have caused these our Letters patent to be made WITNESS our Trusty and Well beloved James Blair Clerk president of our Council and Commander in Chief of our said Colony and Dominion at Williamsburgh under the seal of our said Colony the First Day of December One thousand seven hundred and forty In the Fourteenth year of our Reign. This indenture made in the year of our Lord one thousand seven hundred and fifty between John Finley, gent. of the County of Augusta of the one part and Robert Finley, gent. of the said County of Augusta of the other part. Witnesseth that the said John Finley for and in consideration of the sum of 5 shillings current money of Virginia to him in hand paid by the said Robert Finley at or before the sealing and delivery of those presents the receipt whereof is hereby acknowledged, hath granted bargained and sold by those presents doth grant bargain and sell to the said Robert Finley one piece and parcel of land containing two hundred and ninety seven acres be it the same more or less lying and being in Beverly Manor in the said County of Augusta and on both sides of the South River of Shanando and bounded as followeth, viz. Beginning at two elms and a hicory corner to Israel Christian and land on the north side of said river and runeth thence with said Christian's line north ??? seventy one degrees west one hundred and fifty eight poles to his corner; a white oak by a meadow thence south twenty degrees west; twenty six poles with his line to his corner; a black and Spanish oak thence north--twenty one degrees west; one hundred and forty four poles with another of said Christian's lines to his corner between two white oaks; thence with Charles Dolways line south twenty nine degrees west; seventy five poles to white oak corner to William Finley's land--Finley's lines and corners south seventy five degrees; east one hundred and twenty five poles to a white oak; thence north eighty degrees east; fifty poles to a white oak and black oak on a side of steep hill; thence south thirty five degrees east; forty poles crossing said river between a white oak and walnutt near said Robert's house thence down the several courses of the river one hundred and eighty poles to a hickory and thence on the bank of the river thencefourth sixty eight degrees east; one hundred and four poles to two white oaks in the Manner line corner to said William Finley's land thence northeast twenty seven poles with a Manner line to two pines and a black oak above a red bank; thence north sixty degrees east; one hundred and sixteen poles with a line of Christian's land to a white oak and a black oak on bank of the river thence down the several courses and crossing the river with said Christian's land for beginning. And all houses buildings, orchards, waywaters, watercourses profits commodities and appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise appurtaining and the reversion and reversions remainder and remainders - rents issues and profits thereof TO HAVE AND TO HOLD the said two hundred and ninety seven acres of land be the same more or less and all and singular other the premises hereby granted with the appurtenances unto the said Robert Finley his ex: Adm: and asignees from the day (?) before the date hereof forsaid during the full term and time of one whole year from thence representing fully to become compleat and ending and paying therefore throughout one year of Indian corn on Lady Day next the aforesaid shall be lawfully demanded to the interest and purpose that by which of those presents and of the statutes for transferring uses into possession the said Robert Finley may be in actual possession of the premises and better by enable him to receive and take a grant and release and the reversion and ??? thereof to him and his heirs in witness whereof the said John Finley hath hereunto set his hand and seal this day and year first above written. At a court held for Augusta County the 22 day of May 1750 John Finley in open court acknowledged this his lease for land in ??? to Robert Finley which on his ??? is admitted to record and Mary his wife of the said John being first privately examined in open court relinquishes her right of dower to the land in the said leases mentioned which relinquishments is ordered to be verifyed and recorded with the said leases. This indenture made this day in the Year of our Lord one thousand seven hundred and fifty between John Finley, gent. of the County of Augusta of the one part and Robert Finley, gent. of the said county of Augusta of the other part WITNESSETH that for and in Consideration of the sum of eighty five pounds current money of Virginia to the said John Finley in hand paid by the said Robert Finley at and before the sealing and Delivery of those presents the recording whereof the date hereby acknowledged and thereof date released acquitt and discharge the said Robert Finley his Executors and Adms. by those present the said John Finley hath granted bargained Sold aliened Released and Confirmed and by those presents Doth grant bargain sell alien Release and Confirm to the said Robert Finley in his actual possession now being by virtue of a Bargain and Sale to him thereof made by the said John Finley for one whole year by indenture bearing the date the Day next before the day of this Date of those presents and by for us of the statute for transferring into his possession and his heirs forever one part or parcel of land containing two hundred and ninety seven acres bellow said (?) more or less being and lying in Beverly Mannor in the County of Augusta and on both sides of the South River of Shanando . . . .
